Some advice please

Hi I have a 15 year old daughter waiting for a diagnoses for Aspergers.."we've been fighting for 4 years to get her seen "CAMHS" Today my daughter has been sent home from school because she finds tasks set difficult to finish and finds it hard to concentrate. she also suffers from anxiety and won't communicate"Mute" in a large classroom..and this can come over as rude and impolite..But because she has high intelligence/brilliant artist they assume she should know the work asked of her..They have talked about an exclusion today and for her to work at home.. I feel like the education system is letting her down greatly. They cannot cope with her needs and have even stated her behaviour isn't naughty?. She has her GCSE'S in May and it seems they are only worried about her grades and not her well being! Is there anyone else going through hell with education?

On what grounds are they excluding her? By law they cannot just exclude a child from school there are procedures to follow and you can appeal an exclusion if you feel its unfair, from what you are saying they do not have the grounds to do it and sounds more like they are saying it by way of intimidation so you can withdraw her from school...out of sight out of mind!

 

Can you contact connections? As far as I am aware they help with post 16 education, although she is not yet post 16 perhaps they can advise you on what to do. I am guessing you have spoken to the school senco? Is she on IEP,school action? These would be the first steps for support. She doesn't need to have a diagnosis for them to provide support. If needs be write to the LA SEN department and make a formal complaint mentioning that school have discussed exclusion and you not sure why it has come to this.

How long will you have to wait for a diagnosis?

 

Get yourself a copy of the Special Educational Needs Code of Practice. You can download it from the "publications" list at the top of the Education forum section.

 

As she is having difficulties school should have her on School Action Plus and she should have been referred to an Educational Psychologist and you should have an individual education plan.

 

If none of that has happened, contact your local authorities Parent Partnership, and ask them to help you get your daughter onto SA+ and seen by an Educational Psychologist before she ends up out of school on a permanent basis.

 

You can wait for the EP to see her, or you can ask the LA to assess your daughter for a Statement of SEN that will detail all her needs and difficulties in part 2, and provision and support and therapy should be quantified and specified in part 3 [the SEN Code of Practice explains all this].

 

Although she is 15, Statements are going to be extended to go up to age 25- so still worth doing. There are also some independent Aspergers schools that go on to age 19, which you might consider if mainstream breaks down and the support and therapy she needs is not delivered [some therapy the NHS does not deliver, but an independent ASD school usually has therapists employed on site who can deliver speech and language, social communication and life skills as well as sensory integration therapy etc].

 

This process does take a long time. The Statement itself takes 26 weeks from start to finish EVEN IF the LA agrees to assess and issue a Statement. But start with the SEN Code of Practice and getting her onto SA+. If you feel, on reading the CoP, that her needs are greater than can be delivered by school on SA+ [and ask school what they can provide in terms of 1:1 support and social communication and speech and language therapy and how much input she would get per year from an Educational Psychologist from their delegated funding]. You may decide you need to ask for a Statement now.

 

If the LA refuse to assess, or assess and refuse to issue a Statement you can appeal that to SEND [special educational needs tribunal]. Many authorities automatically refuse to assess, to weed out those parents not prepared to appeal that decision.

Also exclusions have to be logged, and if she is being excluded due to an SEN that is illegal. You can complain to the school governors and you can ask the school why they are excluding her, rather than referring her to the educational psychologist. Do school know she is in the process of being diagnosed with Aspergers?
