  1. I would still take some free advice on this from IPSEA, there is recent case law about this
  2. I think here I would contact ACE and IPSEA, so see whether there is any chance of a SENDIST claim.
  3. Maybe there are high stakes at my son's former school as they are using a solicitor and a barrister. Maybe it's potential C&D issues at the heart of this or possibly they need the best legal defence becuase they have a weak case.
  4. Hi there I wondered whether anyone has been to SENDIST or an appeals hearing and encountered a barrister acting on behalf of the school. How did it go? Was it difficult or easier than you thought?
  5. The less favourable treatment test relating to disability discrimination test virtually disappeared as a result of the House of Lords decision in June 2008. SENDIST hearings will now mostly rely upon the 'Reasonable Adjustments tests'. However when wold direct descrimination still apply? Does anyone have any experience of this?
  6. My 10 year old son has aspergers, ADHD and is also dislexyia. He has a Statement of special educational needs. Last year he received 3 illegal exclusions and 4 formal exclusions. Eventually the LEA agreed to a move to an independant school, where he is doing very well, with no problems. The reason why I am going to SENDIST is to protect other children from what he had to contend with in his last school. Has anyone any recent SENDIST disability descrimination experiences? Rob
