DLA Continued,..

Hi Caroline, and thanks for getting back to me hun. :thumbs:

 

They do not take your hubbys wages into consideration, in other words it does not matter what he earns, the carers is for you, so go for it darl.

 

Unfortunately as you already know my son 12, with Aspergers, high anxiety levels and learning difficulties was awarded LRM and LRC, but am pushing this to the commissioners to appeal for the care side of it, he does not sleep well, the earliest 2 am and mostly 4 am, and I am up until that time with him to reassure and trying to settle him.

So something has gone amiss as the specialist evidence was there in front of them.

 

Never mind, at least being awarded is something for now. :thumbs: , will let you know how we get on too.

I'm sure what the school will send on your claim will be a great help hun.

 

Let me know, and go for the carers, like I said no matter what your hubby earns, this is for you. :D .

Oooh i didn't know that, as i'm not working myself i'll think i'll go for that providing the DLA aprove Hayden's application.

 

I think thats really mean of them only to award your son the lower rate for care, i know exactly how you feel about having to stay up until the early hours of the morning. Hayden used to stay up until 1am & beyond, obviously you can't go to bed yourself & leave them to it! Now he is on Melatonin at night, been on it for three weeks & at the start it was a godsend but now it's really got into his system & i think his body is just used to it now & it isn't having the desired effect...back to the paed again me thinks!!

 

I really hope your son gets awarded at the very least middle rate care, do keep me posted on any updates (fingers crossed for you, thinking of you xx :pray: ) I'd be happy with middle rate care for Hayden/lower rate mobilty, his paed hopes for this too...*sigh* here's hoping anyway...

Unfortunately I cannot claim carer's due to the LRC, if he was awarded middle or high then there would be no problems. :tearful: .

 

My hubby works, and of course I can't because of Daniel, even though he is in school in the daytime obviously, I am spending a great deal of time at the school due to Daniel's anxieties, trying to sort things out all the time.

He had an habit of skipping the odd lesson and hiding away, there was a time we had to report him missing from school to the police, as I walk Daniel to and from school although he is 12 nearly 13, as he has not road sense etc, and make sure he is in that building before I go.

Daniel will not stay with anyone else either, and to be honest due to his anxieties once again grandparents etc cannot cope with him, although mine are disabled, but the inlaws will not offer either. :crying:

 

I do also have an older son Jamie he will be 19 this year, he attends university and travels daily, Daniel adores him, but I cannot expect Jamie to really help out so much now due to all the studying etc.

Good luck with fighting for a better care rate for Daniel you & him deserve it! I understand where you are coming from as far as crossing roads go, Hayden has no sense of the danger of cars at all, when he's in a very hyper mood (which is after school) he will just race across & i'm forever running after him trying to catch him before he makes a run for it. The school STILL have no crossing patrol so it's a double worry. My husband & i agreed tonight that he would stop work & i would start, doing a few night duties in a home called Orchard house looking after children who have ADHD/Aspergers/Autism & downs, it's a respite home for the children (& parents) Hayden is too young to attend as the children have to be aged 11 or over.

 

Spoke to to the SENCO at Hayden's school today & she told me that she sent the form back & what she put, i'm quite dissapointed actually cos on the form it says about if they have any road sense & she put N/A 'but mum says he runs across & won't wait for her'! then she said on the part where it says 'can the child dress themselves' she put 'Yes' :wallbash: so why is it that when i pick him up after PE he has shoes on the wrong feet, shirt inside out, jumper inside out :wallbash: she did put that he has one to one on a daily basis with the teaching support assistant & how he goes out to see the special needs teacher. When the form asked about meds, she put that i give him his capsule after breakfast & it is a slow release one which works during school time.

So i'm a bit worried that they will look at that & think, oh well this child can dress himself afte PE (wrong) & doesn't need help crossing the road :tearful:

And OMG seems like everything written is opposite to what should have been added :tearful: , just like my Daniel's report from the school - hopefully though they will go through your other evidence which is I think more essential !

In my opinion and in my case it was the school report that let mine down yet with plenty of specialist evidence.

Fingers crossed though hun it will be a better outlook on yours, so don't worry yet, and I must admit I had poorly filled in the claim form, and that did not help it either.

 

Daniel has not taken part in PE/GAMES for a very long time now and the head of year had added he takes part, and yet Daniel was staying with him outside his office as arranged by him when these lessons were taking place, as before that Daniel used to skip these and hide in the school toilets. Not only that the head of year was his Acting mentor .....................so annoying.

 

Now you know the school have sent this off - why don't you give the DWP a ring, okay they may not tell you, but they may ask some questions over the phone where then you have the chance to have your say. Good luck, I'm sure you will have better luck than I did hun. :thumbs:

 

You have a very rewarding role regarding a few nights work in that home - good for you and hope all goes well. :thumbs:

Its good your hubby will do this for you. With mine he have admitted he could not cope with staying at home, as many times I have suggested this idea to him.

I used to work for the NHS at a local hospital for the Mentally and Physical handicapped, but then obviously I have had 2 kids, Jamie will be 19 this year :rolleyes: , and Daniel will be 13 in January, and he will not stay with anyone else for me to return to work, and of course Jamie is studying hard now that he have just started university.

My hubby is a Steelworker, and okay its solid hard work, but he reckons he would be more stressed out by staying home lol :lol: .

 

Let me know when you hear of the DLA I am :pray: for you okay, and there is a light at the end of the tunnel whatever the verdict, so chin up, and look forward to hearing from you.

The thing with our school SENCO is that she is always the person i've gone to about everything regarding Hayden, i've gone to her in tears so many times teling her of the very difficult times i have at home with him, about him throwing his food all over the lounge & hiding it, staying up until the early hours, throwing & breaking his things & ours, trying to escape out of the flat (we live on the 8th floor!) & so much more. Just feel let down by her a bit as she said to me that she would make it a really good report, i told her that everything is riding on this report from the school & now i feel that because of what she put they will turn him down :crying:

 

I went a bit mad with the claim form, filled out every single page (apart from the is my child blind part of course) took me two hours!!! lol

 

Sorry to hear that Daniel's school report didn't go well, such a shame when like you say he is his mentor & knows exactly his worries & problems, just so not fair as to why he didn't give a proper FULL report as to what Daniel has to go through :angry:

 

I rang the DWP today to ask them if they have recived the report from the school & they said no, so i'll ring up in the morning - they might give me an answer over the phone? or maybe not.......

 

My hubby certainly couldn't cope during the day if Hayden was not at school age, luckily by the time i get up will be in time to collect him at school with Simon, & thanks to melatonin he now sleeps at night!!! YAY :clap: for the moment anyway lol...he hasn't been on it for long so we'll see...

 

Thanks Di, i'll keep you posted on the job front....really hope i get it, need to be CRB checked which takes about 6 weeks i think so i doubt i'll be starting there until mid December, i said to the girl on the phone that i have plenty of experience having my own child with ADHD/AS, which she said was brilliant!

 

Really hope you have better luck as regards to Daniel's care rate, fingers crossed & i'm :pray: for you too

We applied Dec 2006, sent the claim form back before the end of January 07, received the first letter from the DWP to confirm they had received the claim pack about 7 days later, then a week on they wrote to me to inform me they were requesting for extra evidence from both the school and the Child paediatrician.

I had contacted them at the end of Feb just to ask for an update, they said they had already received the report from the school, but were still waiting for the letter from the CP.

I emailed Cardiff directly in of March to ask if they had yet received the evidence requested and they said it was done and the decision was in the post, and I think then it was April I received this through the post with a refusal, although the date on the letter states March, so basically from the time they received the claim pack which was end of Jan, you can call this approx 8 weeks or so.

 

When was your claim pack received hun to the DWP ?

 

If they have received all the evidence by now and have looked through this then it could be anytime you should hear. :thumbs:

 

I'm sure your claim will be fine...........and if for some reason this does get refused you can always ask them to reconsider, so all's not lost hun, you will get there..........I promise. :D

 

So I assume you have had no further updates from them yet then ?

I got the claim pack on 17th September, filled it in that day & sent it back. Had a letter from them thanking me for the form on the 20th of Sep, they wrote to me after to say that they had requested a report from Hayden's school, the SENCO sent the report back to them Tuesday morning this week, so i'm hoping to hear this weekend (i should be so lucky i know lol!) Just worried still about the school report & what they will make of it :crying:

:thumbs::thumbs::thumbs::thumbs::thumbs: Sooooooooooooooooo Happy!!!!!!!!!!!!!!

 

I phoned up the DLA after Hayden had the appointment with the paed this afternoon to tell them that he had upped his dose of the medication & the man told me that he doesn't matter how much or little meds he's on as they had already made their decision yesterday!! I gingerly asked him if he would mind telling me of this decision & he told me that Hayden has been awarded Middle rate care & Lower Rate mobility!!!!!! YAY so pleased for him :thumbs::dance::dance::dance: he told me that i will get a letter in the post soon to confirm!!!! :clap:

 

Just applied online for Care's allowance :pray:

i am also waiting for a decision for my son's dla.. im so nervous.. im getting anxious waiting but i guess there is hope while i havent heard anything.

 

i received my claim pack on 15th aug and sent back. they received on 24th sept. i had letter 2 weeks ago saying that they cannot make decsion as they have asked for report from school. so i phoned them up and explained that i was anxious that my sons school would understated his problems because it has taken me 18 months to get them to acknowledge his difficulties. i asked them if they had contacted his consultant at hospital who i put on the form..they said they werent going to contact her..

 

the woman on the phone suggested that i write letter expressing why i feel school will understate his difficulties and photocopy any reports i have.

 

well i already sent in a load of reports initially but i had two more from the consultant with his dx on and what it means,

 

but i also photocopied the minutes of the meeting i had at school where multi-agencies were present and recorded all the help they were going to give to my son..thus proving that he does has difficulties otherwise the school would not be giving him help ( fortunately the minutes were on schools letterhead too) i

 

also included a copy of a parents evening report where the school have contradicted themselves on a single paper...on the top it says that my ds can listen and follow instructions directly and indirectly ( which he cant) but further down the page it states ds primary target is ''to listen and follow instructions'' ..why would it be a target if he can already do it?

 

i put a covering letter with the photocopies explaining all this and sent off by recorded..

 

now im just waiting.. but its doing my head in..should i phone them? i dont want to pester them or jeopardise his claim as i feel that we are on thin ice..oohh what should i do?

I called them about my son's claim & they told me over the phone their decision!

well after all that waiting dla sent me a letter saying that i cant get dla for my ds and its baecause the school report said that he has no behavioural difficulties , can dress himslef, can follow instructions adn has road sense... how would the school know about his road sense?

 

i have phoned up and got the explanation and have immediately asked for a review...i am not surprised by what the school have said in the slightest..i requesteda copy of the report from school...

 

funny enough i attended a meeting this morning at school with salt and they have seen my ds and said his langauge difficulties are complex and they cant help until they have new speech and lang assessment - last one only 6 months ago- and they have asked for ds to be assessed by ed. pysch too.. i

 

 

i am so cheesed off at the school and dla...i sent documents to dla confirming that the school do think my son has behavioural difficulties because they have him under behaviour support team and he sees a lady once a wekk for 1-2-1 social skills. plus also his school report states that 1/2 times a week he refuses to work....

 

what happens now? do dla ask school for another report... they didnt even get in touch with the person i put down on the form to contact which was his consultant...a person who recognised his difficulties and not the school who have no idea what it is like to care for a child with asd...

OMG !!

I am so very sorry to hear this................like action replay with ours, the school done exactly the same thing !!

They did not even add in the form that he is on any medication, everything was opposite to what it should have been. :wallbash:

 

I would defo ask them to reconsider this hun, and ask the DLA to send you copies of any reports, you have them all to work by on.

 

Maybe also worth you getting in touch with your local MP, even if they do not know your child, they should write out a support letter for you.

 

It maybe also worth you requesting copies of the school records from the school, which you have the right to do this and photo copy the essential ones you should send to the dla to back up the review.

If your going to do this, do this for as soon as possible.

 

Okay it had taken a while with ours because ours did go as far as appealing, but I have learnt more from this since and am aware what routes to take now hun, and I know you will win in the end.

When this is finally awarded it will be backdated from when you first applied.

 

Your doing the right thing by asking them to look into this again, but if possible try to send in more evidence to back this up. :thumbs:

 

If there is anything else you want to know, please get back to me, okay I'm no expert but have been in the same situation as yourself and try to help as much as possible.

On the DLA form it has a question and I dont know what to tick, can anyone help?

 

It asks - does your child have both a severe learning disability and severe behavioural problems .

 

Do I tick yes or no?

 

Is AS considered severe?

I ticked yes, as some days are awful. remember, you need to think of this form in your childs worst days..

 

My wee girls has AS, good luck with your application, I went to the CAB with mine, as its a minefield!

hi there i have been fighting for dla since jan 2008 i first aplied then 6 weeks later i got the big letter saying no as my son who is 8 needs no extra care or supervision so i asked for a review, and they sent for more evidence and still refused so i snt a nice letter asking to appeal and within the 2 weeks he was awarded no care needs just low rate mobility, so again on the 15th july i have asked for a reconsideration and have sent in further evidence from speech, and educational psychologist, and his ados assesment form saying he is on the autistic spectrum so fingers crossed i am so fed up with it all you cant get what your child deserves angie

Yet again we have been turned down ,I have asked for a copy of the hospital letter and an appeal form .TBH I dont know if i have the strength to fight them even tho I know we deserve it and DS2 needs it what with this and the so called specialists at the hospital I have had it all knocked out of me :wallbash:

Yet again we have been turned down ,I have asked for a copy of the hospital letter and an appeal form .TBH I dont know if i have the strength to fight them even tho I know we deserve it and DS2 needs it what with this and the so called specialists at the hospital I have had it all knocked out of me :wallbash:

 

 

 

Please dont give up, I know your beaten back by the letter of decline but you know your son has a right to his DLA go all the way to tribunal, even when its plainly obvous they are intitled the DLA still try it on, so use what evidence you have in a panel, you do have the energy, as your clearly a fighter, We had to go to panel when J was five, the panel made me promise to fight for a statement, they were apauled with our support, and they gave me advice and a lot more understanding than I was prepared for.

 

They send these declined letters im sure randomly, just to see who will not bother. you son needs you right now, please dont give up.

 

contact a family have some wonderful booklets on DLA and the NAS have welfare rights officers specially for DLA forms.

 

Dont let them keep whats your sons.

Hi there, new here and have arrived with a few questions.

 

Put my DLA forms in 3 weeks ago for my 11 year old son who is currently going through the process of being diagnosed with aspergers. DLA phoned me today with a few questions and said I would get low rate carers as he dosnt get one to one at school (neither do other people I know who get middle rate but hey ho) but they will pay him the outside allowance as this is where he has problems.

 

Now myself and a friend (who also claims DLA and knows a bit about it) are both confused. By this do they mean he will get the motability part of DLA or will I just get carers part for him???

 

They are sending me it al out so I could just wait until then but am a bit puzzled by it all really.

Hello everyone,

 

I'm new here, and have a 10 year old son (Liam) who was diagnosed with AS two years ago.

 

After lots of discussion and arguments with the local education authority, Liam finally got accepted into a special local school last year, after being expelled from two mainstream schools. It seems to suit him much better than mainstream.

 

However I applied for the Disability Allowance after getting the diagnosis - just to allow me to pay for some respite care, as the loacl authority have offered me nothing in this respect. I was initially refused this claim, and therefore went to an appeal where lots of completely un-informed people asked me lots of stupid and irrelevant questions. Unsurprisingly my application was again rejected.

 

It is not really the Allowance money that is now the issue that is bugging me, it is more the complete lack of understanding by these so-called experts who are basically not recognising the fact that I have a disabled son.

 

Has anyone else on here been down this route, and what are your experinces - I would love to hear about them, as I am very frustrated with the whole thing at present. Has anyone else claimed Disability Allownace for AS children ??

This topic shows how bonkers the whole system is !! We applied for DLA and got it and then after 4 years re-applied and have it again, our son is ASD. We got a local autistic charity to help us fill it in, I am sure MENCAP offer a form filling in service as well, good luck. Spike P

i first aplied then 6 weeks later i got the big letter saying no as my son who is 8 needs no extra care or supervision

 

Sorry, can't understand this. To qualify for DLA the child has to need significantly more care and supervision than an average child of the same age. If your lad doesn't need any extra care or supervision than the average 8 year old, then he wouldn't qualify. :unsure:

Hi Clowe,

 

It sounds like they are awarding him the Care component at the lower rate, and also the Mobility component (either at the lower or higher rate).

 

You can appeal the decision if you feel it is wrong.

Hmm not sure why its misssed off the other quote but I think the poster means that this is what the benefits people have said when they turned down her DLA application as its what they have said to me about my 10 year old. Funny how he is the only child in the whole of the juniors who has to wear nappy pants and yet they still think he's an average 10 year old :wallbash:

I have appealed but I'm not holding my breath and I have no fight left in me to go to tribunal ,7 years of fighting for help has worn me out and I cant do it anymore :crying:

yes you can do it dont give up thats what i done but then i went to my mp now we get a care 3 hours aweek up from 3 hours evey 2 weeks nappies and dla hrc and cares as well so go to your mp and dont give up

Thanks ,my mp has just died (although she retired in may) so I'm not sure who her replacement is .I got my refusal letter this morning ,I can see why they have refused it due to the school form that the head filled in .I am waiting for the deputy to ring me as she is the one who I have been dealing with but they didnt write to her *rolls eyes*

 

I am worried about going to a tribunal as I will either loose my temper completely and let rip or I will just cry through it all :wallbash:

 

Its just another battle I can do without right now :crying:
