refused dla again

hi all,

 

after my son was refused dla the first time i asked for a review. i told the dla i have more documents that may help and they said that i would have time to get them in before another decision was made. this was in dec.

 

i got a decision saying that he had been turned down again but gave no reasons as to why.

i decided not to pursue it any further until last week when i spoke to the barkshire autistic society. i have since asked dla for an appeal and they have sent me the forms and i have sent them back.

 

anyway..i phoned citizens advice who are going to help with the appeal but asked me to get a written statement from dla why he was refused a second time.

 

so yesterday i phoned up and dla are going to do this for me but the lady also told me that some new documents have come in in jan and the decision maker is looking at them... these are nothing to do with the appeal.

 

she thinks that maybe a reveiw was made without my new supporting documents being looked at...

 

so im hoping that all will work out....if not then i still have the appeal to go through...which i am very nervous about....anyone else been to appeal...?

Hi, Not personally been to appeal but a friend of mine was turned down first time(not asd but a medical problem)She got an appeal form and within weeks was awarded high rate care! I am at a loss as to how dla work out who gets what. I get middle care but no mobility and phoned the dla this week to ask for a change in circumstanse form to apply and was told not to bother as they will review him in September anyway!??? emmm nine months time! Anyway good luck. If you go to job centre they can give you the name and number of someone to help with dla forms. Lin

Sounds about right!

 

First time I applied for my son the speech and lang therapist rang to say she would send in a report but there time frame was short, 2 days, but they went ahead and totally disregarded her report when she sent it in.

 

If they have decided to look at the other reports they have you may not go through appeal if they decide to award it, but do go right through the system because if you give up they see that as you being untruthful in the first place!

 

Also welfare officers will go through an appeal and any tribunal with you, but only if THEY believe the claimant is eligible.

 

Any monies on winning appeals or tribunal will be back dated.

 

Start gathering evidence from ALL his professionals, ask for appointments if he hasn't seen them recently.

Do not worry at this stage, easier said than done I know, but you will get there in the end.

 

Can you also ask your local MP to help back you up with this and have you a disability key worker from social services ?

 

(sorry if you have already mentioned this - and I may have missed it along the way), but all this helps.

 

With my son's as you will probably already know, we applied in DEC 2006 and he was refused in March 07 and again during the reconsideration stage, and from what you said it seems like they may have done what you said, made the decision by not checking out the further evidence.

 

 

Dan my son was finally awarded both low rates in Sept 2007, after an appeal oral hearing then after a month, I asked them to review this on the grounds of detoriation, they had reviewed this and then he was awarded 'high rate care and kept the low rate mobility'.

 

Funny enough, my sister who is now almost 41 is disabled and have had a few operations just before christmas, where she had put in a claim of DLA, just before Christmas she received the letter back to say this was not awarded, so after Christmas she rang them and asked them to send reasons for why she was turned down as she was thinking about asking them to reconsider this and only had so much time to do so. The next thing they said was that the letter she had was sent out by mistake and they were still considering the claim..........so maybe there has also been a batch of letters sent out that shouldn't have if you know what I mean ?

She is now waiting for the real letter to come through the post, they said they posted this out on Weds just gone.

 

So like I said before you will get there in the end, and like you have done sent in further evidence they do need to look at that in order to make a decision, so I have a feeling this is now what they are doing hun, and fingers crossed this will be good news.

If not keep that chin up and keep fighting..............I promise you will get there and all will be backdated from when you first claimed.

when i asked for a review it was because my ds' school made out that there was nothing wrong with him...said he has no behavioural problems, has road sense and his communication is average..they also said he haas no additional supervision at school..

 

the extra docs i sent were from the school meeting minutes in which it states the extra supervison they give him..stategies to help his communication and writing. plus isent letter from the education dept confirming his 1-2-1 social skills at school and behaviour worker coming to my home to do social stories...

 

when i first sent in the dla claim i sent all copies of all speech and lang reports.. reports from the consultant who diagnosed etc etc...

 

plus now he is being assessd by ed. pysh too....

So annoying isn't it ?

 

Same happened here regarding Daniel's school, they said the opposite of everything, even though he was already under a ED Pysc !

 

I also sent in stacks of school evidence for them to rectify this and typed a letter to inform them the school obviously had the wrong child, I think this helped to get awarded in the end.

 

This is very common of why dla is let down and they DWP always go for the schools for further information as they know maybe 8/10 the schools always add what they shouldn't add !

 

My MP's letter also helped and a supporting letter from the disabilities team, as the first time round, I had sent in letters from the specialists etc, and almost forgot to mention, MENCAP are amazing and think their letter pushed for this too.

Even though Mencap do not know Daniel personally, they make a home visit to you and will write supporting letters, you just give all the information, as your child does not have to be home, and you just tell them what you do to help and care for your child 24/7.

www.mencap.co.uk try these out hun if you have to, but hopefully you won't have to and will be awarded from here. :thumbs:

hi they refused reece dla the frst time but i went 4 an appeal and everybody on here was really helpful and supportive.. i was very nervous but there was three people on the panel had already decided before i got there that he had now got lowrate mobility and then after the hearing he was awarded high rate care and lowrate mobility so go for it it is very longwinded but u will get there GOODLUCK..
