son excluded! school send tutor?

It appears from what you say that the LEA verbally agreed to a statutory reassessment and then changed their minds after advice from the Ed Psych.

 

If I were you I would focus on this part of the LEA response to your email:

 

I will be amending J statement week commencing 10th August and will once it has been checked sent it out to you in draft form for your consideration.

 

Send an email back quoting this and asking if they could please send you the proposed amended statement by the end of next week (whatever the date is).

I agree with Kathryn, work on the fact that they said they would amend the statement w/c 10th August. Even giving them two weeks to re-write it and get it checked by their bosses, you should have had it at the end of August.

 

They will either send the draft, admit they haven't done it yet or say they are re-assessing instead. At least you will know what they are doing.

Do not leave it a week. Call them LA officer every day, until you get an answer.

 

They may have taken your request to approach the school as an implied agreement to an amendment, rather than an amendment, because generally you would only send them paperwork that accurately reflects the child's needs (otherwise they cannot make an accurate decision).

 

Have you rung the school you want and asked them if they have been approached by the LA? You also need to check they still have a place for him.

 

 

I never agreed to ammendment,i just asked where my forms was for the reassessment.. and LEA officer signed the form / minutes etc at the Annual review to say they was starting the reassessment as of June 5th

 

The only reports they have are from school/tutor.. myself as his consultant keeps referring him to CAHLMS and they keep referring him to Autism outreach

who then reffer him back :wallbash:

 

he has got to have a speech lan assessment but at moment there is a huge backlog here.. so awaiting appointment.

 

The school/unit did have a big stack of reports / incidents that they gave the LEA officer at the AR

I have called KIDS so hopefully today i get call back.. no reply for LEA after i sent email..

so i will send another and also send another requesting the draft by a week.

 

 

I was unsure how long it was meant to take so if the advice is that i should have had it by now then im now wondering where it is...

 

I have cc the emails to the boss of SEN and LEA ..and i will email NAS again today and IPSEA and send them that too

 

Got lots on at moment as im due to move soon so really need this draft asap and im on holiday next week.. bit hectic at moment but obv this is my priority .

 

Cannot believe that a the meeting the LEA officer was so keen to get this sorted and now it seems they are messing me around and more importantly my son who is still really keen to go to a school.

In the Summer holidays you requested that J papers be sent to B school to ask them to consider him for placement and Senior SEN Officer wrote a leter to you on 23rd September to confirm that she had done so. She is awaiting their reply.

 

Angela also advised you in that letter that the other preffered School was now full.

 

A proposed amended Statement has been prepared following the Annual Review and is awaiting checking before it comes to you. That will be with you shortly.

 

We appreciate that both you and J would like him to be in a specialist environment but we need to be able to ensure that the schools we are approaching a) have vacancies and B) can meet his complex needs.

I find it amazing that the letter has been sent 2 days before i emailed which is big coincidence in that prev they sent me letter 2 days befor i emailed yet i recieved 5 days later.... oh andi have yet to receive the so called letter mentioned above...

Please can you advise to my next steps as my son is only recieving limited education and he desperatly wants to attend school

His Annual review stateted that he needed a reassessment and i asked for this in writing which was hand given to the LEA officer

sen officer who was in agreement with myself and school that this was needed.. also school said they could not meet his needs and he needed a specialist placement.

 

Any advice would be great as i have been advised that i should have recieved a draft by now if all that was being done was an amendment which was started on August 10th... even though i never agreed to that but only to a reasssessment?

I had understood that there was to be a review of J statement (see attached). However, if at the review meeting it was agreed that a reassessment was necessary and you put this in writing, the LEA does have a duty to consider your request and decide within 6 weeks of it being made whether or not they intend to undertake the reassessment. If they don't they should give you a right of appeal.

 

But, the quicker route might be through the issue of an amended statement and if this has already been considered by the LEA, they should write to you within one week of making a decision to amend it. It seems that Angela Andrews made the decision, but hasn't actually sent anything. The LEA should either let you know that they don't intend to make any changes to the statement or send you a proposal of their amendments. This duty is set out in Regulation 20(13) or 22(10) of the Education (Special Educational Needs) (England) (Consolidation) Regulations 2001.

 

You may be better asking the LEA for the proposal of their amendments rather than pursuing the reassessment request at this stage, purely because the process should get you where you want to be (i.e. an appropriate school place for J) quicker than by reassessment.

Our schools/LA have an internal "post" system, as I imagine yours would. Thus any correspondence should be at a school/LA the next day.

 

Personally I can't see the point in the LA sending schools his old Statement, as it is not an accurate reflection of his needs and therefore they cannot make a proper decidision.

 

I also cannot see why on earth it has taken so long to get the amended Statement checked.

 

They say that one of your preferred schools is full - my guess is they hope if they drag things out, so will the other one be.

im not fighting the ammendment part im just fed up that they are lying to me.. i recieve lots of letters from that part of town and have recieved some from 24th which i got next day and so its strange that i have not got that one..

 

i think backs are being covered and they are not following the right steps even if they are now doing an ammendment rather than a full reassessment.

i was told they would keep me informed all the way this has not happened.

 

Normally the SENco knows in advance and she certainly didnt know any of that..

she also cc me into any correspondence .

 

Im happy to go along with the ammendment but feel the LEA should follow the correct steps.

 

hopefully the KIDS lady will call tomorrow and maybe i get the letter :wallbash: pre dated no doubt.

think i call other school that they said was full to recheck that too

All this non communication seems highly suspicious. I know there have been postal strikes, but still...

 

At least you have a trail of evidence of their incompetence. I hope you get the draft statement soon - it takes long enough to finalise as it is without all this delay! :wallbash:

Yes apparently im going to get it soon...

buti will be getting letter that i supposed should have had.. soon too!

 

The lady from KIDS is going to call the LEA to try find out more

Still no draft yet..

Kids lady said it should be with me any day now

then yesterday i recieve letter asking for my son an mine input report for ammendment to statement

this was already sent on july23rd!

they must have got it as i enclosed a request for 2 schools in same envelope, and they told me without it in writing they could not approach schools...

 

Both schools have turned him down

now they are suggesting an asd tutorial unit...

 

im moving next week as my heating has completly broke now... fed up with all the messing around now, my son is getting more stressed

about it too

 

now the LEA officer is on leave too

 

i have sent complaint letters again to all and its back at stage1...

dont know what else i can do but surely there are some serious issues here?

Blimey, its Novemeber soon, youd of thoght they had of got all this sorted by now, when EVER I sent post to the LOCAL authority I always pay extra postage stamp duty so that someone at the office signs for it, that way I can track down the letter, its about 75p extra but worth it in cases such as these and I photocopy ALL that I send, I never give real copies of anything because they DO delibrately LOOSE all your evidence.

 

I would really be going nuts if this was me, I cant believe how much they have let down your son.

Had a call last night from an ASD TUTORIAL UNIT

apparently the LEA are considering that place..

They are coming round to discuss itwith us tonight.

 

Its not really what we want but im going to listen anyway

 

J said he just wants to go to a school, can i post the link?

as just wanted to know if anyone knows of it

Hi.I have not heard of one before.Does it offer fullltime provision or is it like a PRU ?

If it is a type of provision then you could post a link and people could reply on thread.

If it is a specific place you could probably name it but people would need to PM you with specific information.....I think. :whistle:

Hi everyone,

wow cannot believe how long its been :whistle:

well good news is that my son has been going every day and he loves it!! woo hoo finally, plus only had minor blips no need for him to be held etc.

Had his reveiw just before christmas and all is well.

 

Downside... well statement still not completed.. have finally got a letter last week and its been ammended with his diagnosis added.

 

The origional LEA worker who promised to complete it.. has erm left!

 

So i have KIDS coming Wednesday to go through it with me and hopefully that be end of it.. finally.

And the fact that he is doing so well and not having to be restrained all the time shows that this difference has been down to the placement.

 

Make sure you get everything in the Statement and get his placement in section 4.

Thanks Sally, luckily they have named his placement in sec4 which was my main worry as yes since he has been there his education has

been great.

 

The lady from KIDS has helped me with extras that needed to be included as there was nothing in the "communication" section.

which seemed a bit odd..

 

thanks for all your advice.. just looking up DLA help now as it needs renewing.. I hate forms :wallbash:
