A little worried

Well, we finally moved before christmas from where we were due to it being a very horrible estate and Nick was constantly being targeted... Now he is relaxed a little more but interestingly I am noticing a difference in his behaviour- perhaps it was always there but due to all the cr*p we had I did'nt notice before.. Definately never was before to this extent but if you tell him its time for bed and he goes, no argument. but then when he's in bed he can't sleep and all you can hear is him playing or sighing... i am wondering whether now its a lot quieter he's having trouble adjusting to it... granted we had christmas and what a hyped up stressy time that was..

 

Thing is as we have now moved just over the border into a different county, he still attends his old school as I felt that moving house and moving school would seriously upset him and also he was getting a good amount of support from the staff there who are beginning to understand him more I thought it best for him to stop.. I am very worried though as now I have had a letter from his new LEA saying that they will now be requesting my old county to transfer his file relating to his special needs to them statement etc.. I am worried as it has been an uphill battle to get where we are today and with transferring everything over we might have to start the battles again due to different LEA procedures etc..

 

Will they when transferring his files over change all his specialists over ? we are still registered with our old drs as they are the nearest but its still in the other county... I am scared to phone up anyone for fear that they say we will have to transfer everything over to the other county as then i am very concerned that Nick will suffer until they have everything sorted out and also what if they say all his appointments will have to be cancelled while they transfer it all.. and even more battles to fight from wars I had already thought we'd won..

 

he has just had a letter and questionaire from the ADD clinic but despite me telling one of the consultants who I saw that we had moved they sent it to the old address (at least if they had sent it to the new address I could feel a little re-assured..)

 

I am not sure what to do or what is the procedure here. I didn't realise that I was actually caught right in the middle of hell and damnation ! stay and get grief from where you live but then the support is in place educationally or move where sanity is and get grief from the LEA..

 

 

Argh

 

Has anyone else been in this situation and can throw a few reasurring words my way..

 

Well got to go now and pick the darling little munchkin up... thank crunchie its friday !!!! hmmm chocolate..

I'm not that clued up on the education bit but you CAN keep your old GP - and your dentist - I don't know about hospital consultants etc.

 

I would think you could make a good case for keeping Nick at his old school - doubtless Nellie or Phas will be along with some excellent advice soon ... :lol:

Wondering if the scenario is this:

 

You have informed current school you have moved. They have altered their records and the old LEA have decided that as you no longer live within their area if he is to continue to be educated by them your new LEA should pay for the provision. This from their point of view is quite reasonable. However, as far as your concerned I assume the current school is named on his statement? If so the CoP is pretty clear on this. Whilst the new LEA may wish to carry out a review of the statement provision(they are entitled to do this) the statement is still a legally binding document and should be adhered to until after any review is completed.

 

Now, this is going to develop into a row between the LEAs as to who should pay for the support. That is an argument that does not concern you. You cannot be made to move him out of his current school by anyone, new LEA or old LEA. They wouldn't bat an eyelid at school catchment areas within the county when a house move moves you from one catchment to another (been there, done that), and I am not aware of any reason where this should be the case when you have moved from one LEA to another (someone correct me if I am wrong). Whatever happens leave him where he is - don't let them tell you you can't.

 

I would contact IPSEA as soon as possible about this (TODAY) and see if they agree with my thoughts. They are bound to have come across this sort of thing before. I am almost 100% sure that this will be a spat between the LEA's over funding, that being the case it is their problem to sort out. As for hospitals, where I am we are equal distance between 3, in most cases we can choose which to attend. Again I doubt they can make you change hospitals against your will, the 'N' in NHS means 'National'!

Hi Ksnanic .. have just been through this and I fully appreciate your worries, as far as NHS stuff goes it is a case of insistence and gettng your old specialist to contact new specialist in our new area. As far as the new area goes, the new lea HAS to comply with the statement unless they can prove that it is an inefficient use of funds, which in your case I don't think it is as it just a couple of miles difference, there will howeve be some wrangling over responsibility etc .. IPSEA are really good at this and I have quite a bit of experience at the hard end so to speak ... its been a long day, but I have loads of legislation regarding SEN and moving boroughs that may be of help, all I can say is don't panic we are here to help, unfortunately th NHS and PCT trusts are a rule unto themselves but LEA stuff I can pass on.

My experience with the NHS is that if you move house, you can stay with your old doctors/specialists etc, even if you are outside of their catchment area or even in a different county (have done both myself and have been able to remain with those doctors I wanted to).

Oh thankyou loads everyone... I was feeling quite desperate and scared but now I am feeling as if ok whatever happens they are not going to force me and Nick to comply with what is easier for them but for what is beneficial to Nick..

 

As to the specialists etc thanks Phas - national does mean that, so thanks for reminding me...

 

Any other info would be most appreciated... forwarned and for armed etc..

 

Off to bed now, worrying has made me very tired !!

We have sent our ds to a school in the adjoining county and were not aware of his sen at the time of choosing it. It has caused some difficuilty but more in the school being faced with a new situation. We have been told that when your child is under school action plus, it is the LEA in which the school is in that pays for and supplies services such as EP and support. When your child has a statement, it is the LEA in which you live that pays for support and you will probably have a new EP. Services concerning health ie speech and language can be linked with your GP so you would not need to change these. Hope this helps.

Hi again - Good news regarding the NHS specialist: as of January 1st this year patients can choose between at least four hospitals or clinics for non-emergency treatment. i would assume that this will mean you can also choose to remain at a particular hospital - it's worth printing out and sticking in your pocket to shove under someone's nose if necessary ... :lol:
