  1. They say now they received it on weds. The paperwork was sent by the head- she sent it via the school courier system so it was collected on 1st june - last day of term. Lea say that then after being collected by school courier it wouldn't come into the lea until after half term so where exactly did it then go for a week? No one can explain that and even then it's taken until weds to get to lea. Sen officer has called and is still in meetings - she is looking at the case next week. Head is now chasing lea as it parent partnership (although we know what she is like!) I will speak to SEND on monday and try and find out how much time they have. Regarding the lea getting upset about private OT report - in my parental report in June last year I talk at length about the sensory issues Joe has plus also tried to get paediatric referral in sept which I have in writing then the next referral in nov so I can show I tried every way I could. Parent partnership says my OT report is very good . School placement needs to be asd specific special school. There is a maintained one 30 miles away or an independent one 35 miles away -we have no special schools in county so will have to be out of county
  2. right spoken to sos sen - i do have the right to appeal as although we all go round calling it an emergency review it is an early annual review so the the normal rules apply and i need to the statment to be amended or not as the case may be - the law was updated a couple of years ago to give us this right - there is apparently something on the sos sen website so im off to go and find out about it. the review did follow teh exact procedure of an annual review ie reports etc so i should be okay - the only problem is of course that there is no timeline attached to how long the lea can take.
  3. or do i just wait again until the annual review in november? will try and contact ipsea - makes the whole theory of emergency review pretty pointless then really doesnt it - should have just moved to a reassessment of his needs in the first place rather than going to emergency review. things getting worse - trying to contact the sen officer for 3 days - she has they say been constantly out of the office. joes paperwork sent back to lea day after emergency review on 1st june - lea now say they have never received the paperwork back which is pretty poor - it was definately sent so im pretty angry that they have lost it all. thing is regardless of anything the school have said they cant meet his needs so hes got to move school - they cant leave him there so they will have to amend the statement and surely if tehy amend it i should have the right to appeal as they could name any old unsuitable school. my head is literally spinning!!!!
  4. thank you sally as always - that is very good advice - i am still waiting for the sen officer to phone me since yesterday - phoned her again today to be told that she was out all morning - shame they didnt tell that to me yesterday when i phoned and they specifically said we will get her to call you in the morning. we are thinking about returning him to school on monday to see how he goes - if the sickness continues next week then we are going to ask for a part time timetable although the other part of me thinks that as its only 5 weeks maybe just bite the bullet and keep him off - no sign of sickness today although i thought he had been sick last night as i found sick in teh bathroom sink this morning - spoke to dh and he leaves for work at 5.30am and he says it wasnt there then so sounds like hes got up very early this morning and been sick then before i woke up - would explain why he slept in today. parent partnership as far as i can see is just her - dont think she has a boss at all. it is clear the lea have spoken to her. i will phone the lea again tomorrow as i need to hear it from them that is what they are up to as so far it is only from the parent partnership - its all irrevelant anyway as even without the OT report he was still struggling at school and they would still say they cannot meet his needs so they would still have to do something but i think its because the OT report recommends specialist placement - and we all know that a NHS ot is never going to do that as its going to be so generic - the advice in my report is coming true - that he will struggle to cope
  5. parent partnershiphave phoned me - im really unsure about how independant they are. she is making a big deal over the private OT report saying that an OT report should have been asked during the stat assessment which end last nov and the LEA not happy that ive got a private report. she says the lea are completely right to now to go and get their own nhs report and i should sit now and wait whilst they do this. i wont get the statement from the ergency review back until they have done this. lea dont understand why i got a private ot report even though i gave them a letter showing that the nhs ot wouldnt do it. the referall to nhs ot was done by a member if the councils own staff! at a meeting in april lea woman agreed to emergency review and talked about getting evidence etc . joe was having huge problems with ot at school so thats why i got a report - unfortunately for the lea it raised huge issues for joe and thats why i think they are not best pleased. my parental view at stat assessment did mention his sensory issues, the medical report mentioned some motor issues - maybe i should have asked for ot during stat assessment but then surely the lea should have well! made second phone call to sen officer to call me back - still silence - major avoidance going on here i think. but as soon as school mentioned issues re sensory issues i did try and do something - is it really my fault the nhs wouldnt do anything and that a private report clearly indicates how complex he is.
  6. Thanks Sally. I am going to keep him off today and tomorrow and then will get an appointment on Monday when I will take my husband who will happily say what needs to be said. He was sick last night at home as well. I checked his bmi - its 15.9 - I can't allow this to continue. He is still asleep even though he is normally up at about 6am - think his body is exhausted and tired. Rumour I have from parent partnership is that the lea are more concerned about our OT report and are considering whether to get their own before they do anything else so they are going to try and string this out for months. I just need that statement back so I can get onto tribunal
  7. joe has been sick 6 times today at school - he has been sick every day since monday and every day for the last month at school. we now have a vomiting diary for him. school have said they cant meet his needs at the recent emergency review. lea have now gone very very quiet indeed. his statement is for 20 hours but school said even with full time support they cant meet his needs. we have asked for a specialist asd school place for sept. i have been very concerned about the sickness and when the teacher told me 6 times today it really concerns me - he is underweight and is seeing a dietican - he is on 2 milkshake supplements a day of 300 calories each. he saw a p ead a few weeks ago and she put it into writing that the sickness is anxiety based. she actually said to me that the sickness will only stop when he changes school though she didnt put that quote into her report but made it clear that the sickness not due to any other medical reason. took Joe to duty gp today who has given me some medicine as he is concerned about how his tummy is coping with the vomiting. i asked him if he could sign joe off but he said wouldnt do it for a child but would make sure that today was documented so the evidence needed there if i need it. so now im torn - do i keep sending him to school where they cant meet his needs and hes vomiting every day or keep him home which could be indefinately with how my lea are acting. i tried to contact the sen officer today but told she was out all day but i dont think she was . they said they would get her to phone me tomorrow but i dont believe for one second that she will. i suppose im worried taht i could make things worse for joe and that the lea would drag their heels even more or not at all and could end up with him out of school forever - hes only 8 years old.
  8. I'm at home all day. We do not have Camhs at the moment only a paed. She has put it in writing that there is no medical reason for the vomiting - will try and get him to the gp. Think lea will try for mainstream with unit but we do think we can argue this as he would have to go into mainstream. My other son is in this unit at the moment and it's been awful - have in writing from head that only non verbal kids go into the asd unit - Joe is average ability so also couldn't go in MLD unit - lea gave Joe a place in the unit last year even though he had no statement but head out him in mainstream and he lasted 6 weeks so that's already a failed school for Joe. We have no special schoolso so it will have to be an out of county placement - local sen school at primary would be no good as the children are severely disabled. I will get the gp appointment sorted - we have a new gp starting next week so appointments should be easier to get hopefully.
  9. I have the minutes from the meeting yesterday - it clearly states school cannot meet his needs and even with additional support they can't and they feel he needs a new placement for sept. I emailed IPSEA and they replied this morning so I have also written a further report this morning to go back with all the paperwork statin that he needs a new school and we are now in a difficult position with school unable to meet his needs and him being sick every day. I have told them the school I would consider and have said I was open to suggestions if they had any school they felt would be suitable. I also said I was not happy about only being given 90 mins - the lea had all the paperwork 2 weeks before so knew it would be a long review and to phone a week before to change the time etc n they knew it would then leave only 90 mins is ridiculous and feels like game playing. All gone back to the school now and head will send to lea today - their is a sen panel meeting on 6 th June so fingers crossed that his case goes before the panel. I have signed the minutes and I watched the head sign hers as well so that's that - it's offical that the school cannot meet his needs. Have been to the independent school last week - met the children would be in joes class and they would have a place available for Joe in September so now let's see what happens - the code of practice states heybhave 1 week to inform you of the decision so if it does go to panel next week I will give them until the end of the following week then I will start the pressure on them and ask if it didn't go to panel why not otherwise next panel is beginning of july
  10. Favouring the independent school in nottingham as my lea do send quite a few kids there but we didn't really discuss placement as time ran out. I spoke to IPSEA earlier and sounds like the lea could have up to nov to amend but sure I read they have to be fair and reasonable so nov too long. Hopefully getting the paperwork from head tomorrow so will get that straight back to her and then going to not think about it over the next week. I'm just gonna have to wait but will keep on at them especially as the sickness continuing. School cant meet his needs so how can he stay there? Also not sure what to do if the sickness continues

Don't think there can be any dispute over not meeting need - it was said in front of parent partnership who minutes it and the head said it several times - my husband and myself both minueted it - however just despair at the game playing involved with a vulnerable young child - it's just so wrong that they can behave lime this but I should be used to it by now. Lea have asked school for lots of evidence of various things - such as sensory circuits Joe does etc. Will hopefully get the minutes from head tomorrow and then try and get the paperwork back to school with any additions from me. Best get saving for more independent reports

Lea officer after rearranging the review appointment last week from pm to am walked in and sad - you've got 90 mins I've got another meeting to go to and then we just felt under intense pressure. Lea not happy that private OT report been done - really narked her when I produced the letter from nhs saying the don't commission OT for sensory integration. She tried to argue ep report made Joe look fine till I pointed out he had highlighted one area of improvement but forgot to mention the areas where Joe had declined. School made it very clear then cannot meet his needs even with full time support - he needs a specialist placement. OT report recommends this as well. School say the OT report is an accurate assessment of joes needs. I provided 3 letters to show that Joe being sick every day at school is down to anxiety. School also now ave a 'vomiting' diary. I handed over a statement with all of my amendments in which went down like a lead balloon. We pushed her to agree a date when they will let us know the decision whether they will amend, agree a change of placement etc but she would not commit to anything So meeting ended with nothing at all decided except school can't meet his needs and a son whos anxiety is making him sick every day, who is disruptive and school can no longer cope with. Have no idea what to next - it just seems so wrong that I have provided evidence etc and I'm expected to sit tightly and wait whilst as each and every day goes by my son detoriates. She heard that I am being phoned to collect him - I'm am now in limbo and am so tempted to phone her boss as 90 mins was just far too short - she knew what was coming and knew damn well that it wouldn't be enough time.
  14. thats an interesting point sally - noone has ever said anything about 48 hours - i just take him back in the next day as everyone seems to accept that it is indeed his education making him ill not that he is actually ill - he is absolutely fine when he comes home - sometimes he is sick in the eveningbut again think this is the build up to school. bit of a nightmare now cos got to go down and get his twin come home then get car and go and get the other asd boy from his school as hes got trampoling - ocme home again and then go out and take daughter to sibling group and the pick her up again and of course dh at work to 10pm and my goodness its hot here today!!!
  15. he has been sent home again today because he has been sick at school - i kinda predicted it as they had a pyjama party this afternoon and he freaked out this morning when he saw his pyjamas in his bag - had to hide them in his twin sisters bag. tried to get gp appointment - none for 2 weeks but managed to get him a paed apppintment on monday
  16. The question was how many teacher is county have specialist autism qualification - reply information not known to the lea. This is held by individual schools. Autism outreach I asked what qualification they will hold - answer was experience of working with children and young people whose special need is ASC. Also asked how many staff directly employed by them had an asd qualification and what training do the council staff have in autism - reply was only post asd specific is inclusion officer post (post holder is qualified to level 5 ib autism and aspergers) they provide training for customer facing staff. Interesting that the inclusion officer post(which is old autism outreach job) only asked for asd experience - they are lucky they've found someone with level 5 qualification but in reality they didn't have to even have a qualification. His current placement is a mainstream school and I know no staff have any asd specific qualification. The school have asked for training - ed psych sent them a DVD and they are awaiting someone to come in and do some training.
  17. I did look at the school you mentioned - it's 55 miles away so unlikely he could go as a day pupil. We have autism outreach - but they made her redundant at Xmas and replaced her by an unqualified teacher instead who in despite of numerous requests by me has yet to see my son - no one from outreach seen him since we came here a year ago. The sickness - a mixture really - they tell me about it, phone me and last Friday I did take him home. A friend who is doing a masters in asd looked at the statement yesterday - it lists a social skills programme which she says can only be done by someone who is experienced in asd so I should ask for autism outreach to see him one morning a week which we know will not happen. OT and ed psych have advised workstation for him - my friend again said this needs to be done by someone with experience of asd not a generic teacher. She thinks they will offer full time support but I'm not happy with that as he needs a more specialised placement. This is I feel heading to tribunal though my lea have no special schools so will ultimately back down. I'm looking at a school in nottingham on Friday and there is an independent one near Leicester which is asd specific. I actually did a freedom of information request re staff with asd qualification - the lea said that apart from autism outreach they could not say if they had any other member of staff in county as they don't hold that information - I would have to approach each individual school
  18. hi, sorry dally didnt see you advice until too late - got teh ed psych report yesterday - was pretty pants - just did the same intelligence tests that he did last july and made exactly the same recommendations for his statement as before. Joe is being bullied and is not coping ins chool due to the sensory / social side etc. he is making himself sick most days and self harming by picking at the skin on his arms. the ot report has recomended loads of things - they say he needs a specialist placement with asd/adhd qualified staff and be a combined theraputic and educational setting, a sensory diet, weekly OT, ot to provide strategies for his behaviour and give advice re adaptations of his classroom/school enviroment, a motor skills programme and a report for each review which will be for 2 and half hours - he has problems in every single area she assessed. she recommends that he should not even access mainstream pe lessons as it is too over whelming for him. she says that joe has complex needs and a significant number of difficulties which are affecting his function in all areas of daily life. he also has hypermobility in his hands and feet/legs - he has sensory modulation disorder. the report is very detailed and lists loads of things for parts 2 3 and 4 of the statement - the report has been served on the lea before the 2 week deadline of the emergency review. the ed psych just took joe into teh heads office and did the testing - he did not observe joe in the classroom enviroment at all. joes comments in the report quite telling as he says that he is being bullied and he cannot cope with the noise etc but teh ed psych has completely ignored all of this side to joe. the only extra recommendation he has made is to add in a behaviour management plan. i do also have a letter from the nhs OT service saying that they do not commision OT services for sensory intregration
  19. just a quick update - ed psych seeing him this friday - reports should have been in by thursday so its going to be late - i have the other reports my private OT report was amazing and is recommending specialist schooling - thats where the headache begins as even finding a suitable school isnt going to be easy - viewing an asd specific one next week. my next job is to now go through the statement and start looking at all of the amendments that will need to be done to the statement - feels like it will be a mammoth task at the moment. think ive ruled out a unit placement as they would expect him to access mainstream at some point - the local school has over 300 kids in it and he cant cope with a school with 100 in it plus i cant stand the head - she is awful and she feels the same way about me!!!! another issue i have is parent partnership - made the fatal error of asking her to the review without meeting her - now met her when i took copies of paperwork down and she is so on the lea side! she was already telling me that i will have to accept the large mainstream school with a unit even though there is a lot of personal history with the school, joe went there for 6 weeks and was very badly bullied, the head of the unit lied and we can prove it as well as i kept copies of all the letters etc.she just said so little and i dont know if she is going to be an advocate for me at all but feel like she is pushing for the lea side - so now im seriously thinking about uninviting her but can imagine it will go down like a lead balloon so think i will just have to put up with her and never go near her again after the meeting!
  20. i can show that they have made quite a few mess ups along the way so fingers crossed in the next couple of weeks i can find a good school for him but its difficult when schools just dont seem to get back to you
  21. my problem is that he needs to come out of the mainstream - going to look at some special schools - was going to send him to mainstream with a unit but think that may not work either and you need to make sure statement watertight otherwise they seem to end up back in the mainstream - he needs to go to a school with experience with asd children. his presence is now detrimental to the other children and dont think the school will have any problem saying as such as well. on a positive note - alhough my lea has becoming awful since the new sen person came the people above seem to know she is awful - how she is stil there i dont now with the amount of complaints about how incompetent she is - my lea have never been to tribunal over an asd child - they usually agree to out of county independant places without going to tribunal which i think is pretty unusual so i just need to dig those heels in and make sure my case is watertight - i can sh

    not sure about apps but make sure you get a good case to put it in - they are very slim and seem quite delicate - i have the otterbox - the griffin is also very good as well although seems to be out of stock everywhere at the moment unless you like pink. mine has been dropped a few time and the case has protected it really really well
  23. the school placement is now detrimental to joe and all of the children within the class - he is not coping and is unhappy - last week every single day the school were talking to me about his behaviour - the school are completely out of their depth my worry now is that with such a quick turnaround is how am i going to get a salt to see him on the NHS within 3 weeks???? im considering maybe getting a brief private salt report done just to at this stage highlight his difficulties - if we are heading to tribunal then will need a full one doing. im mad at myself for being so gullible but i had hoped he would be okay - i have a hell of a year with the lea last year regarding my other son and we went down the judical review route - it all did get sorted and when i got my younger son joes statement i was so grateful just to get it without a battle - how stupid am i? the statementing officer here is ###### -= everyone knows it including her bosses and i have been advised by other council members to try and get her off joes case and get her boss to deal with it - im solely tempted to do that - with my older sons case she didnt follow the correct procedure either but as she is the only person who seems to know sen law down there everyone seems to listen to her even though they all know shes rubbish. i tempted to email her boss and complain that that with joe the assessment was not done correctly and therefore i have no confidence in her and would ask that the boss come to the meeting instead.
  24. hi, the EP did write a report for statutory assessment which was qite good but only now as i go through it did i realised that the parts of the report were not put in the statement - they didnt turn the page over! when joe was assessed for dx he has numerous assessments then and the EP used a lot of those results in his report rather than his own. the school are desperately trying to get the EP back in to write a report but he is being elusive - i think the LEA have spoken to him a nd have a feeling thats why. the head has even left her personal mobile number for him for him to call her but still no response. i asked at a meeting with lea a few weeks ago why no SALT report has been done - she said that it was due to the medical officer not picking up that he needed SALT even though in the report the medical officer did comment that Joe struggled at times to understand her instructions. Im not sure how i get SALT involved so quickly - my head is great but not that exerienced in the senco role - did think about doing it privately for SALT but the quote was for £1000 plus. The OT report is being written by someone who does have experience of tribunals and the report will be written in such a way and will detail the help he needs in part 2 and part 3. he came to the home and went to school - his teacher , head and TA all spoke to her and she offered them loads of advice for school - im hoping the report will be here in the next few days and i expect that she will say he has SPD. the annual review has now been set for 31st may as we are trying to get a suitable placement for sept as
  25. Son statemented for 20 hours nov 2011. He's in a mainstream school - same class as his twin sister - he's 8 years old in tear 3 and has aspergers and ADHD. Academically on paper he's okay. He's struggling in school - he's shouting a lot in class , has no friends, has huge sensory processing issues. Things have reached a head- spoke to school and they agree they can meet his needs academically but not socially, emotionally etc. Meeting with lea was called - it has now been agreed to call an early/ emergency review on 31 may Head is senco and seems quite inexperienced re special needs. During statement process no salt or OT reports were done. I moved Joe mud statementing process no school report was done - just his year 2 sats. Ed psych did usual testing - Joe has a spiky profile. A private OT came to see Joe a week ago and we are awaiting the report - I intend to amend part 2 3 and try and name a new school placement in part 4 - it could be a unit or maybe special - I can't decide yet where is best for him! I just want to make sure the correct process is followed and what I need to be doing. I assume I need to do a report of some kind and at some point let the lea see the OT report. Head is asking teacher to do a report - I've asked her to write it honestly. Head is trying to get ed psych in to write a report for review but he has so far been elusive as have autism outreach. I want him to o to a school where they have asd experience and strategies. The head inexperience worries me slightly as she was talking about doing the review with just her and me and my husband!
