Annea Report post Posted November 27, 2007 When my dd's applicationw ent in, she was offered higher rate care and lower mobility 1st time, no problems. I have just received a decision on my youngest daughter <not yet diagnosed> she has a lot more mobility problems, behavioural problems wetting etc etc... She has been turned down. I just received the evidence they used to make the decision and the school have said she has no problems!!!!! I am very furious! They seem to have ignored the peadiatrician who said she DOES have the problems I have stated. They have also ignored the extra information I sent in from her Physio therapist. SHe has once weekly class physio, once weekly 1-1 physio and physio daily at home as well as wearing splints at night etc. I have decided to go down the tribunal route, but does anyone have any advice on how best to do this? I have considered paying for a private assessement to see if I can get a diagnosis sorted... it's just so frustrating! Anne Quote Share this post Link to post Share on other sites

Annea Report post Posted November 27, 2007 Thanks Di, When I spoke to the woman on the phone about the decision, I asked if she had taken any medical or specialist advie on board and she said and I quote " DLA is not given for a medical condition" So I said that the medical problems cause the symptoms that my daughter has. When I said about her wetting at school, she said, again I quote " Isn't your daughter old enough to wear pads inside her pants, surely she can change these herself, the teachers say she doesn't have problems" I said the teachers don't even seem to know when she is wet either.... They are idiots... and I am so angry at the head! The head said my dd had no problems with road sense, but she has NEVER taken her out of school and never had to cross roads etc. my 10 year old can't even tell the time, knows the days of the week, the months of the year and doesn't know her adress... di30 Report post Posted November 27, 2007 Hi Anne It was down to the school why Daniel's was originally let down ! And for that woman you spoke to on the phone that was not on !!! I'm not surprised you feel the way you do, they make us feel like we're begging and its disgusting ! I have noticed a lot of claims are let down due to the school and I seem to think they use that more so in evidence than any medical evidence given........its very naughty I think. Don't forget your key worker should be able to help you out here, think you said you have the same one as me and as he deals with a lot of issues to do with the school he has written a great report regarding a review on Daniel's dla award. Daniel has now been moved full time to a special educational need class and to be honest between the key worker and mencap they helped with this, as this have been a right battle for the last year sorting out his school issues where they now realise they should have done this ages ago ! But its only since we have had the key worker etc everything is getting done and resolved. Go for it hun, and get all the help and support from these people, you will find they will help all the way, good luck. Fingers crossed for you. Let me know how it goes, cheers. Di.
