URGENT HELP PLEASE

If there is anyone out there please tell me.....

I am appealing part 2 3 and 4 of statement, which has to be in on Monday. I have had conflicting advice from different sources.

 

Can I just put the bare bones in now and send the details later ?

 

Someone else has told me I have to put the whole thing in with all evidence, history of my son's case, what he's like now etc , specific details of argument against school etc etc......

 

At the moment I have got:

I am appealing against parts 2,3 and 4 of the statement issued by.....

1. the final statement is not an accurate record of the severity and complexity of my son's needs.

2. the provision described in part 3 does not meet his needs appropriately

3. the school named in part 4 is currently failing him and is therefore not able to meet his needs appropriately as described in the code of practice.

(Further details and evidence to follow)

 

I then attach a copy of the statement with all reports attached and a list of what we think is wrong with it.

 

Later on I will send more detailed argument against school.

 

Is this ok or do I have to do a long version with contents sheet and all that???

 

I'd be really pleased for any advice. It is going to be a long night.....

This is what the SEND website says and this is also my experience:

 

Grounds of appeal

You should identify the decision that you’re appealing against and give the

date of the official letter you received notifying you of the decision.

You have to give the reasons why you are appealing. These are your

‘grounds of appeal’. Your reasons don’t have to be lengthy or written in legal

language, but you need to say more than just, ‘I disagree‘. You should explain

why you disagree with the decision you are appealing against and what you

are asking the Tribunal to do.

If you have information or evidence which supports your appeal you should

enclose it when you send in your appeal.

 

When we write to tell you we have registered your appeal we will send you a

Case directions form and an Attendance form. This will tell you the dates

by which you must send the Tribunal information to consider at the Hearing

 

I think you have plenty to send in for now - I think there is definitely a case for holding back your arguments until later, so that you don't give the LEA preparation time to argue back. As you see from above, you will be given a date to send in the follow-up info.

 

SEND write and ask for more info anyway, if they think you have not sent in enough to register your appeal.

 

When I sent in my appeal, I just said what specifically I disagreed with in the statement and sent in a copy of his statement and all his appendices; plus I said where I wanted the SEND correspondence to be sent i.e. if I wanted it sent to a representative or myself. Everything else I sent in later.
