is this admissable?

in the case statement is a report from home tuition, its M,s yearly report.

surprise surprise we have not been sent a copy.

it has not been signed either by the headteacher or assistant headteacher.

im wondering if i should take as late evidence with me to the meeting that we were never

sent this copy, sendist says i cant send anything in now as its only a week to go.

 

So, just to recap

1, there is a yearly school report as their evidence that we havent seen.

2, they have him down as unathorised absence for a day that we know nothing about

3, theres the minutes of a meeting that LEA said they didnt take and neither did school.

4, there is reference to an email between special school and lea saying that M cannot go as there

are no places and they have to be "strict about the diagnosis"

5, The Ed Psych is going who has never met M.

 

i cant send late evidence but im thinking of writing to lea to ask them for a copy of this email that

was allegedly sent as they are citing it in their evidence.

You need to discuss these issues asap with your IPSEA rep. You can try getting the evidence in as late evidence but otherwise there is nothing stopping you(IM O) telling the Tribunal on the day what is in the document. As for an ed psvch who hasn't seen a child - what is the weight of that evidence! You might be able to object to them taking any account of the yearly report if its unsigned as it could have been written by anyone if there not there to be questioned. Do ask for the email Good luck

ooh ive got a list as long as my arm to discuss with my ipsea rep!!!!!

also in the lea,s case statement is a letter from the head of the primary school they want him to go to saying

that she doesnt think there are enough hours/specialist provision for M at her school and she wants them

to bear inmind that our psych says its crucial to get the right TA for M or it will fail.

wonder why they have included that in the evidence?

its not very good for them is it?

they havent agreed to one single item of our request.

do tribunals take a dim view if an lea has not tried to sort anything out?

At the tribunal hearing you'll get the chance to have your say about all of these issues. They take just as much note of oral evidence presented on the day as they do written evidence. Having said that you can present evidence of the day as long as you take along 5 copies, it wasn't available to you prior to the late evidence deadline and as long as it's not too long or something along those lines, can't remember the exact wording. The LEA can object and the panel can decide not to accept it but even if they do decide that it doesn't qualify as late evidence you would still be allowed to read it out at the hearing. You would just say, I have a copy of a letter written to such and such on blank date which I would like to read to you......etc.
