Hello, ive not been on here for a while, i needed a break as it was all getting too much.

 

Today we had a meeting at M,s school with the Head,LEA,NHS Psych,our private Psych and a teacher from the school.

 

M has been out of school since Nov05, he gets 4 hours a week home tuition, he has been dx,d with AS by a specialist psych, he was turned down for an asessment for a statement and we are going to tribunal on 26 September.

 

So, M,s old school closes tomorrow and a brand new one opens in September, it is an amalgamation of 3 schools and the class sizes are huge, we dont want M to go to this school, we and our psych want him to go to another school which caters specifically for ASD pupils.

 

BUT, it is out of our borough, i dont understand how this works, obviously the LEA will say no straightaway.

 

Now as we are going to tribunal and hopefully we will win does this mean that M can go to another school outside the borough and then in the meantime continue with home tuition?

 

Sorry if it doesnt make sense, im just a bit confused thats all.

If M is still signed off sick, then the home tuition can continue. Should be a minimum of 5 hours tuition unless that's too much for M to cope with.

 

I'm assuming that the tribunal is about the LEA's refusal to assess so all the panel will be looking at is whether or not the LEA should carry out a statutory assessment to ascertain M's needs. At this stage they will not be looking at school placements.

 

If statutory assessment is carried out and a statement issued but you do not feel that the school named in part 4 can meet M's needs, you can then appeal to tribunal again to see if they will order the LEA to name the school of your choice.

 

Very long winded and bureaucratic, but unfortunately that is how it works.

I agree with Tez.If your tribunal is in September and they order the LEA to assess for a statement than this could take another 6 months if not a bit longer, then if you go to tribunal again because you are not happy with the statement or school named in part 3 of the statement than this will take another 3 months so you are looking at July 2007 for challenging the statements and getting the results you are asking for.

Another thing, the NHS Psych said today that she doesnt need to be involved in M,s case any more as our private psych seems to be doing well with M.

 

Our psych said to us to remember that he,s not employed by the NHS.

 

When you are going to tribunals/getting a child asessed is it necessary to have an NHS psych on board?

 

Sorry about the questions but i dont really know how this works.
