DLA/RECONSIDERATION/APPEALS

Hi.

 

Due to my 12 yr old son's DLA claim being turned down the first time, I have asked them to look at this again.

Even though plenty of support letters from the Child specialists, Senco and family members went in first time with the claim, i had come across more since.

 

Anyway last week I had asked them to reconsider the decision, sent the further info support letters i came across and even a letter from my MP.

 

They have confirmed today by a telephone message that they have received all support letters etc and the letter from the MP, but they never indicate how long this will take to reconsider.

I know this will vary, but my son's decision when turned down the letter was issued 13th March but I didn't receive this until last week.

 

I am a bit confused regarding the reconsideration and the appeal side of things, while I am waiting for the decision on this should I still fill in an appeal form ? Or wait for the decision of the reconsideration ?

As I don't want to waste any more time !!

When I asked for reconsideration (this was last year) the wait was 11 weeks. What I mean by that is they have 11 weeks to reconsider the case. In that time i submitted everything i could. I even asked complete strangers to write down what they witnessed when M went mad in shops and tried to hit people, throw things off shelves etc. I know 11 weeks sounds a long time but it did give me time to send in lots more info. I wrote a diary for a week detailing everything I had to do for M. I asked a friend with a child the same age as mine to write a letter telling them that he was not age appropriate and I asked my mum and dad to write detailing how routine based our life is as well as the account they gave of how stressed he was on holiday etc. Appeal I think will only come if your reconsideration is turned down. Our reconsideration was and we went to appeal stage. However I was told even before appeal it is looked at again and can be awarded before the appeal. Ours for M was.

 

As far as I know you have to wait for the decision before you go any further. You may not even get to appeal stage. :thumbs:

Hi

 

After learning that my son Daniel's claim for DLA was turned down, I wrote to a lot of support groups including the NAS (National Autistic Society) in which yesterday they sent me an attachment letter which also provided support etc for me to email this to the DLA, this gives a full explanation of what Aspergers syndrome is, and how it affects the ones who has this, as I have a feeling this is not understood. This gave stacks of information with also references supplied by the professionals.

 

Anyway due to me asking them to reconsider this decision coming up 2 wks ago, we are now just waiting to hear hopefully of a new decision-this could take upto 11 weeks, and yet my mate told me she was told 11 weeks but heard between 2-3 weeks.

 

All further evidence now sent with as much info as possible to support this decision and if I have to I will be appealing too-if they still haven't changed it, I'm not going to give up that easy.

 

Anyone else going through this, do not despair, you will get there in the end, I was extremely upset when they turned my son down for this, especially knowing he is definately entitled to this as his rights due to his problems.

 

The DLA dept must understand we wouldn't apply in the first place (as much stressful as the form is) if we didn't think our kids were not entitled to this and waste all that time and energy filling these out !

 

I have received so much support, and going by each others advice on these forums have been a great help too, I just wish I had come across this site before !

 

It seems like one long process-but in the end it will be worth it !

 

Some maybe luckier than others, which is great news to the applicants who haven't had to appeal etc, and thats great, and I am so happy for them-well done !

So this proves we can win if we don't give in !

 

We will help each other out. I have picked up so much info and advice from these forums and since joining I feel more at ease and am so glad I have found this site.

 

Like I said if my son is turned down after reconsideration..........I am definatley ready to appeal.

 

I will keep keep you posted of the process and good luck to everyone else too.

Fingers crossed that you get it without having to appeal, Di.

 

I only knew what DLA was because of this forum, it's entirely due to the support and information here that we got it.

Much appreciated.

 

Today I had an e-mail from my MP's secretary who informed me they had some acknowledgement from the DLA who are currently dealing with Daniel's claim, and the Secretary will be sending me a copy through the post for my records, she said I should hear something asap !

'fingers crossed'.
