Support hours specified in statement

Recommended Posts

My LEA have a matrix system in place for mainstream statements. However, I would like the number of hours 1:1 support specified in the statement. Can the LEA refuse to specify hours?

If they are breaking the law would someone be able to point me in the right direction?

Thanks very much

Hi Catnidge, welcome to the forum,

Your LEA have a legal duty to quantify and specify your statement.

You can find information on this site, http://www.ipsea.org.uk/ look under campaigns and alerts.

It might be worth calling their helpline for advice and support.

The DfES code of practice points out that the provision should normally be quantified i.e in terms of hours of provision, staffing arrangements etc .. the LEA's must not, in any circumstances have blanket policies not to quantify provision.

COP 8:37

If you can get hold of the ACE Special Education Handbook: The law on children with special education needs, it is really helpful in putting the COP into understandable terms.

Don't let them fob you off, many LEA's rely on the fact the majority of parents aren't versed in the legislation.

Hope this helps.
