  1. Bid he has 5 hours of tutoring a week, an hour a day.. Kazzen161 I've looked around and found the perfect school but it's in another borough and their LEA say it's full even though the Head says it isn't.. Enid that's awful, what help did you get in those 14 months.. what happened?
  2. What is the longest a child has been without a school.. I'm just wondering as we are almost on our 5th month with no school with no hope of one for the rest of the year so say 10 months of no school.. Is there a certain amount of time the LEA can look for a school, do they see if a place comes up? What happens? Could it be possible he never returns to a school? It's just getting more and more hopeless.. T's moods of frustration are through the roof. all weekend he has been a ball of rage and uptight it's really wearing us out.

This was my last post about it: http://www.asd-forum.org.uk/forum/index.ph...mp;#entry259645 Now a policeman phoned myself and said that this boy had done it before the trip to a girl at the school, but they are taking her statement into consideration and not my sons. It won't go to court as "they don't want to put him through it" and "it would be the same outcome anyway".. So now he has a final warning and that's it!!!!!! The school knew he had done this before and let him sexually assault my son, with no staff around for the night! What can I do? I can't let it go, it's a kick in the teeth for every autistic child who is assaulted. They have no rights!!! I'm so upset.

There are no other steps, they took it to their superiors and they just said they would do a proposed amended statement naming the "full" school school and approach them even thought they said every school in that borough was full. So now to wait until they say NO again and then appeal..6 months for appeal so he'll be out of school for 10 months. What makes me SOOOOOOOOOOO angry is if a "normal" child had been abused for 2 years and then sexually abused in the school's care, THEN their parents took him out of school there would be outrage!!! So this happens to an Autistic child and they just don't matter.. no school for months and five hours a week in a community centre. I've been to AM's MP's a Lord, councillors, Children's commissioner for Wales, IPSEA, SNAP, NAS.. everyone. There is no one who can help us! I'm so fed atm
  6. If you look up my other posts you will see we have no school and are going into the fourth month.. The LEA took it to panel to ask what to do and they said if we wrote/emailed them with the school we wanted they would do a proposed statement and approach the other borough as it isn't in Cardiff.. I've been onto this borough and they have said no spaces and Cardiff had money for provisions and they are looking after their own children, she wasn't nasty just honest.. How is this step with the LEA going to get us a school place? Is it just shutting us up for the time being and they will come back with nothing?

  11. From my other posts on here you will see that we took our son out of his previous school as he was abused in every way possible.. So far he has been out of school for 3 months, no places anywhere.. I've even done my own research and looked at other schools and found a fantastic unit but it's "FULL".. I've contacted councillors, AM's MP's even a Lord.. Also the children's commissioner for Wales, Disability groups, the ombudsman you name it.. SNAP, IPSEA, NAS.. But we always come back to the same thing everywhere is full and physically full. We could go down the tribunal route again and spend £5,000 and still not get the school but it's a total waste of time. My social worker is setting up a package of taking my son to a community centre with care workers, taking him out to the park etc and then having a tutor for an hour a day.. I know I should be grateful but I want him in a school, he is missing peers and valuable social bonding as he "wants" friends. His education so far has been awful, I'm just not getting anywhere. No schools, no places and going round in circles.. On June 4th apparently the LEA are going to have a meeting with their seniors to discuss the case, unless they can build a provision overnight It'll come to nothing. What do we do? No way am I going down the residential route as last time this happened he was sexually abused.. I'm just and feel so empty and defeated..
  12. Michele we have the same thing happening in Cardiff. At present there are no places for my 13 year old son, he's been out of school for 3 months now.. They are building an Autistic unit on the side of a High school here, only excepting 4 children year 7.. My son will be a year 9 in September so he can't go and I think it's disgusting myself but apparently not illegal. I was told by the Children's commissioner for Wales that they are trying to resolve the problem for Autistic children as there are presently no places in Cardiff and the surrounding boroughs.. So they build this "super Autistic centre" and are trying to fill it each year starting from year 7, similar to a high school.
  13. Who are paid through the LEA? It's just the Tutor for T said today that she isn't cheap and that they should be looking for a place for T to go to.

  15. I've C&P ed this from an email to ipsea to save typing it out again but we have exhausted almost everything. 3 months and counting since he hasn't had a school and NOTHING out there. We are trying to find help for our autistic son Toby (d.o.b. 29/12/95) who we have currently had to withdraw from his school due to physical and sexual assault. It looks like he is not going to be able to go to a school for the foreseeable future as Cardiff LEA are unable to find a school that can help him. At this point we have no idea what to do next to help Toby or who we can turn to for help. I know you probably get many e-mails, so I’ve tried to keep this as brief as I can, this information is by no means complete but it has the main points : * LEA sent us a statement naming a school that we believed to be inappropriate for Toby * Request for change of school to an appropriate school denied by LEA * We successfully argued at SEN Tribunal that the named school was inappropriate. Unfortunately the Tribunal couldn’t name the school we wanted due to it not having capacity for even one more child, so Tribunal was adjourned to a later date so we could look for other schools * LEA told us that they would name H******** School (an Action for Children school that deals with children with ASD and also children with behavioural problems on a day and boarding basis) on condition that we withdrew our appeal. We did so, and Toby started attending H******** at a cost of over £50,000 per year to the LEA. The school we wanted would probably not have cost the LEA anything. * After an initial good start at the school Toby suffered many physical assaults and was assigned a one-to-one support worker to shadow him in school for his own safety. At this point we had asked for an early review as we thought the school was no longer appropriate for him, but suspended our request to allow some changes the school had made time to bed in. At this time, Social Services Child & Disability team were about to issue a notice on the school under section 47 of the children’s act. * Toby went on a school trip to France during which he was sexually assaulted by one of the other children (who was at H******** for behavioural problems rather than disability). Although a teacher had sat outside the door until the children appeared asleep, they were essentially unmonitored during the night. The sexual assault is currently being investigated by the police, and the school carried out an internal investigation, which we were not happy with. Action for Children have now arranged for an independent investigation to take place. * At this point we permanently withdrew Toby from H******** as we found them incapable of keeping Toby safe from harm. In the meantime, the child who sexually assaulted Toby has been allowed to return to school and now boards there with other children. We have heard unofficially that this is because H******** believe that there is no realistic chance of conviction due to Toby’s disabilities and his ability to be cross examined. * Since this time, Cardiff LEA has not been able to find Toby another school, all schools being classed as full. We found a school today that was appropriate and told us they had places, but when Cardiff LEA contacted the LEA for the school they were told the school was full. * At present, Cardiff LEA provide a small amount of home tutoring as they are unable to provide a school for him. We have no idea how long this is likely to go on for, and we think the whole situation is proving damaging for Toby.
  16. Thanks all for your replies, the NAS are short staffed today and I haven't been able to talk to anyone. The solicitors we have been recommended are £250 an hour, it's ridiculous! Madme I'll follow up the info you have put here, thank you ever so much. emmacroombes thank you too, that would be great if you have something. and I will keep you all posted.
  17. I did a post a few months back of how my son was sexually assaulted whilst on holiday with the school. Now that the police have my sons evidence and the other accused persons evidence there is talk of dropping it as my son cannot be cross examined in court as he has ASD???? Has anyone come up against this as it's clearly wrong. This just puts out the message that is you want to abuse a child make sure they have special needs.. I'm beyond angry as there is no one which deals with such a delicate situation. I feel totally let down and as a result my son and our family are suffering terrible and my son has no school and hasn't had one for 3 months now. Also there are no places out there whatsoever

  19. Can a section 47 be carried out if the child in question has been removed from the school? Can a section 47 be carried out on a school? I've been told this by my SW and they aren't proceeding any further with everything which has happened (see my last post), I feel totally let down by someone who is supposed to put my son's welfare first.

  21. It isn't stupid I'd love T to cut his nails as he also hates having them cut and wants them long..nightmare!
  22. We have done the same as above in the past. He is 13 now and it can take up to an hour for him to dress as he seems to be in a world of his own and playing mosquitoes with his hands. He hates certain clothes too and the feel, so I can feel your stress <'>
  23. My DH is a godsend, we face everything head on together. If he wasn't around I'd be in a loony bin by now. My MIL can be great too, she lives 25 miles away though so not close. She had T for three nights while we went to London, so we had one night of full sleep extra it was wonderful. My mum is good too but works a lot but helps out when she can and she is only 12 miles away.

  25. Thanks everyone for your replies.. My son is home today as the other boy was removed and under police investigation.. My husband will get him tonight as I am a total mess over this and will cry or say something I will regret. I've been told it's going to be huge and I have a solicitor and legal advice, my son will be removed from this school and an early meeting to place him elsewhere is within days. Isn't it funny how the LEA co operate when something this disgusting happens, when they totally ignored us before when T was black and blue and chewing up his clothes as he was seriously disturbed when in this school!
