DLA Reconsiderations

Hello everyone, I am expecting Dan's DLA reconsideration result to be decided any day now. I sent off loads more supporting evidence and i'm feeling quietly confident this time.

However............. I'm desperate to know how many of you got turned down at first attempt and awarded after reconsideration and how many didn't get awarded after reconsideration.

I just don't want to get my hopes up just incase :unsure:

I was refused it at first attempt, so i appealed and asked them to contact all the medical professionals involved in Ts life to make it clear to them that T was not 'no more hard work than a child of his age' along with making it clear AGAIN that my son required a lot of care daily.

 

After they reconsidered T was awarded high rate for personal care & low rate mobility.

Nope my son Daniel was turned down during the 'reconsideration' !!

Sent in stacks of evidence from specialists etc etc, but like the DLA said it was down to the school report why it was not awarded.

So annoying due to the fact I had more FOR than AGAINST regarding the evidence that was sent.

 

Anyhow I am hoping to receive some updates reports from the school and the Ed Pysch this is due to ongoing concerns of Daniel and the conslusions etc including a 'mentor' on 1-1 help and support, oh and supervision that they admit they are finally giving him, this was not stated from the head of yr from the school to the DLA on the report he sent, all should be rectified soon in order for the appeal.

 

I will let you know when i hear.

My daughter was awarded high rate care and low mobility on reconsideration after being turned down initially.

Caroline,

 

You will get there in the end for your Dan, either way don't give up fighting for this, I was devastated when this was let down especially on 'reconsideration' but at least you can still appeal.

I hope they award this for my Dan too, the DLA dept informed me they will look at it again and if the decision is still not changed then it will be passed on for tribunal. But I will not give up, I know he is entitled to this, he is 13 next birthday and he does not and will not go out alone, has all the difficulties with communicating, easily led and vulnerable, the list goes on, but I am lucky to be in bed by 3am 7 nights a week.

 

He is so compliant in school and very disruptive at home, basically we can all look out at home once he is distressed.

 

(The evidence is there in black & white from his specialists), i feel as if not all the evidence was looked at, only the schools report which is totally incorrect), and that was it, they looked at this one and made up their minds not to award him.

 

They do seem to go by the school reports more so than any of them in my opinion, from what I have read on these forums and people i know, but as long as this is rectified i cannot see any further problems.

When I sent extra evidence for reconsideration, I sent a cd with video evidence of melt downs. These had the date and time and some of them were in the middle of the night. I'm not sure if that helped or not, but he was awarded high rate care until he's 16.

 

I felt awful taping him, (was very careful not to let him see the camera) but there's nothing worse than being made out to be a liar by these people, which is basically what they are doing when you've told it like it is and they still reject it.

We got middle rate mobility because his school submitted a report that said he played football and basketball. He can't catch a ball. Went to reconsideration and got awarded highest rate for care and mobility.

Our claim was rejected on first application but I got it at reconsideration after submitting additional evidence and reports.

 

I've just had the review claim accepted till 2010.

Most of the replies looks positive, great news. It's well worth it in the end.

 

As mine failed on 'reconsideration' lets hope its changed before the appeal lol. (due to incorrect school report). I have informed the dla about this.

'Fingers crossed'.

But do they contact the school again on appeal or just go by our reasons and explanations or so ?

I have sent in stacksful of evidence/support letters etc to support my son's claim cheers.

Im not sure if they contact the school again di?? Hope not, they sound pretty useless lol!

Rang the man again yesterday and he said it will be another week before Dans case gets looked at again :wallbash:

Hi caroline, so another week you have to wait ?

Thats annoying considering the guy said he would let you know the decision early this week.

If they do ring the school or ask them to fill in another report, this time they should correct it !!

I do think since we have spoken to the school and he have seen the Ed pysc since that they would have to rectify it.

 

Another thing too, everyone including all staff call my son Darren and Darren Daniel, but i must admit they do have some similarities lol !!!!!

Makes me wonder if they have been doing a report on the other boy instead of my son, I know its a huge secondary school with approx 2000 pupils to cater for, but they should still be careful what they are doing.

 

Daniel was diagnosed with Asthma too as a baby and has a few inhalers including steroid, and must take the others to school, on the report they ticked NO medication is recorded or taken !!!

Hmmmmm i do remember as plain as day filling in the med form as we do every year and they should keep these on the school data records, oh and he needs to be told to take them too !!! To me this is still medication, so they have defo gone wrong somewhere along the line.

 

Hope you hear sooner than next week !! I'm sure i waited about 3 wks during reconsideration but you must look at it this way too 'no news is good news' so fingers crossed hon !
