NickyB Report post Posted October 1, 2009 Hi all. DS was excluded again this afternoon after he hit a teacher. Since the LEA decided not to carry out Stautory Assessment, he has been excluded twice. I have sent in the SENDIST appeal papers already, including details of the first exclusion, but was wondering if it would be worth writing to the LEA as well and explain that the situation is deteriorating. Are they likely to reconsider if I write or will I have to wait for the appeal process to grind its way along? It's all so frustrating as I really think his needs might be better met at a specialist school, and I can't do anything about that without a statement I hope that makes sense - my head's in a spin right now
julie1 Report post Posted October 1, 2009 I think staying in contact with the LA is the best thing to do, write to them explaing the new situation keep a copy of the letter and send it to Sendist if its not to late for additional evidence. In my experience showing Sendist that you have been open and trying to communicate with the LA works, it show that you are trying to keep lines of communication open this is very important. And you never no the LA may back down you have nothing to loose. Keep trying.

JsMum Report post Posted October 1, 2009 In the early days before Js statement, I wrote to the Local Authority Special Educational Needs Manager and then CC it to his GP, CAMHS, MP, Social Worker and the Child Developmental Team, all by recorded delivery, photocopy everything and file it. I would also ring ipsea about the exclusions as it may be a disability discrimination issues. Good Luck with the statement. JsMumxxx
Kathryn Report post Posted October 1, 2009 Tough times for you, but could be useful ammunition for your appeal (it's awful to have to think like that, isn't it ) Definitely write to the LEA, it may make them think again, and at the least, it's useful up to date evidence of the school's difficulty in meeting his needs. The appeal process gices you a chance to send in further information so it would be good to send in the correspondence relating to this latest exclusion.
