help needed meeting tomorrow

I have also been told by IPSEA that when you write to school, if you want the letter on your child's school file you need to request that it is put on their file. Also copy it to the head of the SEN department.

I didn't know this and thought that all letters to school were automatically put on their record. That is not the case.

So make sure it is on the file otherwise there is no documented evidence of your complaint or point of view.

i am feeling so drained, i just want everything to just disapear. I dont know how much the LA think a parent can take before they just colaspe and give in. I have had to do 2 tribunals in the last 15 months for my older 2 children. my littlest one is starting reception next term and is struggling with all the change, my other dd2 is in school for just 1 hour a day, and the LA said thats how it is going to stay until 15 jan when we next meet up to work out if dd2 can manage anymore than that. She is not refusing to be at school no one will listen to the fact she is not safe at school. The emergency placement has been turned down as has our request for our choosen school. The LA said it is a specialist school for ASD and Dyslexia, she has neither of those and i had to accept she has MLD and therefore needs a MLD school. The MLD school has said she is to clever and her accademic scores are to high for MLD school. The LA said i was not to worry they can push them to take her they need to look at her IQ of 60 not her accademic scores. I said if you took any child and put them in a jungle for 2 years there IQ would drop and that is what they have done to my child. there was no response. but it looks like she will have to go to LA MLD school, i feel like they have written her off.

I do not know have the experience to know what to advise.But please don't blame yourself.None of this is your fault and you have certainly not written her off.It is the school and the LA who should be ashamed of themselves. :wallbash::tearful::angry:

Even if your daughter was refusing to be at school the LA would have to make better alternative provision than one hour a day.

Are the LA sending out written confirmation regarding the refusal for emergency placement and naming the chosen school ?

I think they should confirm in writing and notify you regarding your right to appeal.

Please do not accept the proposal for the MLD school yet as this is what they hope you will do.Take a breather and obtain some advice first. >:D<<'> >:D<<'> >:D<<'>

I have edited having woken up a bit.

Have you had a draft Statement yet ?

I realised that as far as I understood it a draft Statement could not be produced because the LA were awaiting medical advice [EEG and MRI report from paeds]

If you have not had and agreed the draft Statement yet the LA should not be naming a school.That would not be legal within the COP.

They can probably refuse the request for an emergency placement but I am sure they cannot turn down your request for the proposed school before the draft Statement has been produced.

Please do not agree to anything until you have obtained some professional advice from IPSEA or NAS.

Stick to your guns, the MLD school have also said that they cant meet her needs so you have evidence that she doesnt have a MLD, the LEA tried to do the same to my son by sticking him in a over perscribed MLD school, the HT went baserk when I turned up to visit as she said she has places for 70 children and there was now 85 and they are bursting at the seems but the LEA told me not to worry about the numbers because if they feel it is the right school then they have no choice but to give J a place, I said to the headteacher that J has ASD and other problems and they where too abdement due to his high IQ they couldnt meet his needs either but the LEA didnt listen, they will try there best to squeeze her in a local authority special school rather than find a special school that reflects her needs in the name of money.

 

So do stick to your guns, with the MLD issue they will look like they will go all the way to tribunal but dont forget they pull out days before sometimes, this could all be resolved by the 5th January when school reopens.

You have won 2 tribunals dont forget and your much stronger than you think, agree with all that KarenA has said and get them to put into writing the refusals, I did this too, obvously with the help of our solisitor but it is best to get them to put it in writing to why, that way it is extra evidence too for tribunal.

 

I cant believe that your LEA are trying on it with you considering you have taken them to tribunal and won.

Just another thought about the IQ who did this assessment and when?

 

What about a private educational pyschologist assessment?
