freedom Report post Posted October 14, 2008 hi there been a while ok we were going to tribunial on tuesday next week so all the paper work in place reading up to get ready for it and suddlenly my phone wouldn't stop ringing the LEA has backed out and given me everything i wanted with out going to tribunial, they are writting up the statement to what i agreed to and naming the school i wanted too they are also letting me call the shots with how we get Emlyn back into school how long it will take everything just sorting out the funding for the tutor to stay on the help him threw this till he is ready to go it alone we think that getting him back into school full time will take at least 3 month may be longer but we are now moving forwards after a year of hell and him lossing a year of schooling basically they backed out cos my case was water tight and they didnt have a leg to stand on lol so so happy Quote Share this post Link to post Share on other sites

lynne Report post Posted October 14, 2008 Hi Freedom, CONGRATULATIONS Before you withdraw from the tribunnel make sure the statement has been written how you want it. This also happened to us and the LEA asked us to withdrawn our claim. I refused to until the statement was written. When they did write the statement it still was not written correctly. So we had to revamp the statement ourselves. But our saving grace was not withdrawing from the tribunnel until we had the statement correct. A statement can be done in 24 hours and the alterations can be made the next day. We done all ours via email with the LEA. So its not a case of waiting months for the statement. Why did they have to put your family through this if they KNEW that you were right, I get so angry when I hear about cases like this. Very, VERY well done for having the strength to go all the way and win through. I know I wouldn't have the energy or strength to do it and see it through to the end, so you should be very proud. ~ Mel ~ At the end of the day the reason the LEA or what ever new name there under now, do it to save money, its also a combination of what parents know about SEN legislation and how well supported the parents are in the process, many parents feels they have not got a chance, supported by the boss at LEA, so they dont appeal, some dont even know they can, and worried if they do it will cost out of their financial budget and so dont go there, or wait for more evidence, breakdowns and deplorable acts of deteriation. It sure is very hard going throw the process, its a real uphill challenges, if the LEA can saves Hundreds of thousands of pounds on a specialist place they dont mind spending thousands on trying to persaude the family to think about trying x,y and z again even though they have been tried, tested and failed. Its all about money, its no longer about meeting the child individual educational needs anymore, after November all I can foresee is its going to be even harder for parents to be as successful as many have been lately here. K x yep there are so many things that we could all agree to here but the biggest and most important one is our children i am not strong just very very stubborn and read every little thing i can get my hands one to see how and where i stood i think i know every word in the SEN code of practice now lol and they hated it when i quoted areas of it too the other thing that has helped me in this year of hell is i have taken the LEA all the way to the ombudsman and that is now looking like a high court judgement on them as they have breached and broken so many rule policies and proceedures that they are stuffed in every way i have also taken the school that they were fitting for threw the governors and they are not happy that law breaking things have happened and my sons life was put at risk so all in all i have cover my back, front, top and bottom fully and they couldn't do anything to break my evidence the one thing they hoped would go in their favour was the independant ep report and much to their discust it backed me up and proved how much damage they had done to my son in this last year my advice to all is too make sure you know your facts and always stick to the facts get everything you can to back you up and read all the SEN code of practice and laws that should be followed if your case is water tight they will not like being made fools of still in disbeilf here but i do have all the working documents of the statement and as it is so close to the tribunial they have to send a copy to sendist to prove they have done what they have said they have lol fools Quote Share this post Link to post Share on other sites

lynne Report post Posted October 15, 2008 I think for every person who wins a tribunnel there are lots that do not bother to go to tribunnel. Or they start the process but are unable to complete it.
