col Report post Posted August 21, 2006 If by any chance both of you have the same one, take her down some pegs at the tribunials that way when i have to go to trubunial to get my son assessed. She won't know if she's coming or going. As that's the way it's is seriously starting to head towards
PinkSapphireAngel Report post Posted August 21, 2006 Oh I will, after her nonsense at the refusal to assess tribunal in March and her bad mouthing me to everyone since she will not know what has hit her. Just need to try to get my head together and get my evidence sorted again for my case statement, although I don't think there is much different to say that I said last time and in my assessment evidence. Just be harder to get myself organised as I will always have Luke with me even when the other 2 go back to school and nursery in September as I will be home schooling him, that reminds me I will also have to contact the education welfare officer again then to confirm I am home educating at the moment as they said they will need to get the home education inspection team involved. Daisydot Report post Posted August 21, 2006 I will she is so lovely ( ) can't wait to face her again lol Good luck with yours, is it against refusal to issue statement too? No, ours is against the LEAs refusal to name the school we want on the statement (the Borough do not have a school which can meet our son's needs except mainstream with a 1-1 LSA (unqualified). , and to "make the statement legally watertight " as the solicitor puts it - in other words to make the statement give clear education provision which specified exactly how much, when and by whom SALT and OT and 1-1 help he gets. Good luck with yours. Our officer is GW, or it might be JW at the new school I think. Is one of those yours ? or do you have LC, heard horrors about her, but never dealt with her personally. By the way, have the Borough offered you mediation ? They have offered us, and I didnt know whether to accept or not. PP say it will help our case to accept, so provisionally we have ... do you have any experience of mediation, is it worth going down that route ? Daisydot My officer is the dreaded LC and everything you have probably heard is true!! The LEA have NEVER offered mediation and when I told the last tribunal this LC piped up that she had (lies) I said the only thing close was the letter when they refused the assessment and gave the mention of PP, LC said that IS mediation!! That is obviously ANOTHER lie isn't it?

That is obviously ANOTHER lie isn't it? PSA, I'd say, based on my experience, that is a big lie. When Bill was turned down for assessment and I had a tribunal date, the LEA officer contacted me personally by letter and phone to request mediation in a location of my choice. She organised the whole thing. It didn't achieve a statement but as far as explaining the reasons and negotiating extra support it was very worth while. Daisydot Report post Posted August 21, 2006 (edited) I havent had anything from the LEA officers, but we did get a letter from the PP asking if we wanted mediation and I emailed back to say yes. haven't heard anything further from them though, I suppose once the tribunal date is set they will come back to us. I dont doubt for one minute that LC was telling porkies, I know only too well the perils of what lurks beneath the Civic Centre ! Daisydot Report post Posted August 21, 2006 And another thing PSA, dont worry about them sending out an inspector whilst you are home schooling. You need to register with the EWO in September that you are teaching your son at home, then you are legally ok, they will ask you to provide a timetable and return it within I think its 14 days. It doesnt have to be the national curriculum you are teaching him, you just need to say what you are choosing to teach him. The PP told me that they wouldnt get round to sending out an inspector for at least two terms. So concentrate your efforts on the SENDSIT and send back the timetable as they request and just do a little with him each day towards the literacy and numeracy subjects and then do more if and when you have completed compiling your case for the SENDSIT tribunal. I used workbooks from CGP (sorry I dont have email as not at work at the moment, but its something like www.cgpbooks.co.uk) which you can get online quite cheaply, and you can buy according to your son's Year and ability. I also found lots of websites with worksheets and stuff for them to do whilst I taught mine at home. Apart from that I just did stuff like reading and cookery with them when I could fit it in. Good luck Daisydot

PinkSapphireAngel Report post Posted August 22, 2006 Still have not recieved the confirmation letter from SENDIST, have emailed them again to let them know. I have also sent a brief letter to the LEA to let them know in writing that we strongly disagree with their decision not to issue a statement and feel they have not taken the many reports which formed the statutory assessment into account at all in making their decision not to statement. I know they know we disagree as we have appealed to SENDIST and PP are talking to them but I thought reading others experiences it cannot hurt to put it into writing. PinkSapphireAngel Report post Posted August 23, 2006 (edited) Well I have just heard back from the PP and they have come up with LOADS that was ignored in the note in lieu and sent it to the LEA officer who says she will have to go through it with her line manager (love to know who that is) and will reply in the start of term (just to be really helpful of course) . PinkSapphireAngel Report post Posted August 24, 2006 Having looked through what PP found they have also shown where she has actually REWORDED direct quotes form the reports (reports from their E.P, the specialist paediatrician, the school, even from the LEAs own Autism Outreach specialist teacher!!) I have emailed PP again this morning after discussing it all with dh and am telling them we feel it unfair we are expected to wait yet again when we are NOT the ones making "mistakes" and asked if there is anyone else senior available for her to discuss it with if her so called line manager is away (BTW Does anyone know who her line manager would be, you can PM me if you like) I have also suggested we could forward it all to the head of the LEA if there is not anyone else

PinkSapphireAngel Report post Posted August 24, 2006 Probably the Director of Education for the Council - ring their switchboard and ask for the name or check the Council's website Go Girl She is an SEN officer (her title, god knows how or why) so I thought there might be someone between her and the director of education himself (who I have had dealings with already when he sent a nasty letter to my mp about me saying I am only doing this to get him into a particular school

You don't live in one of the old Ridings do you? Sounds like our LEA! Try asking for the name of the councillor who chairs the Education committee instead then! PinkSapphireAngel Report post Posted August 25, 2006 The lady from Parent Partnership has known me since early 2001 and is lovely. She is hopeful when she talks to the line manager she might just turn the note in lieu into a statement (will believe it when I see it of course) I showed her the nasty letter the head of education wrote about me and she is going to speak to him and put him straight that it is NOT true and explain how long I have been fighting for this help for Luke. She will also speak to education welfare and explain why Luke is out of school in September. So right now we are still having to wait till she can speak to the line manager in the first week of term. PinkSapphireAngel Report post Posted August 27, 2006 Today I have spent all day going through ALL my emails (going back 2 YEARS) about Luke to sort them into new folders ready for complaining, also Parent Partnership want to see all the emails I sent to the LEA officer which were ignored during the statutory assessment 3 months. makes me feel so drained and stressed as it reminds me how long this whole secondary school thing has actually been going on for me (I started asking LEA for help and advice just on this issue alone in 2004!!!) As for fighting for a statement, THAT has been going on since 2001!!! Have sorted all the emails I sent and recieved from LEA, school, MP into their own folders now. LKS Report post Posted September 3, 2006 Hi PSA <'> <'> so sorry for all you are going through. Don't forget it might be worth going in to the civic centre and asking to see all paperwork they have regarding Luke. You have to contact the data protection officer there, sorry don't have his name. You might find some very interesting stuff in his file. I did for my kids including lots of letters between school and LEA that I had not been copied on There were also copies of e-mails I had sent them. Might be some help for tribunal. <'>
Daisydot Report post Posted September 3, 2006 Hi, PSA, our solicitor just told us to contact the Civic Centre to get all the information - I will email you with the data protection officer's name - apparently you have to pay a fee of ?10.00, but the solicitor said its worth doing and to the school as well (they should have kept records even though he is moving on to secondary (or not !). Also, we have asked the NHS for their records - I will email you all the contacts. Daisydot

PinkSapphireAngel Report post Posted September 5, 2006 Well my so called SEN Oddicer seems to still be playing games. I contacted PP this morning to find out what was happening their end. They emailed back to say they had spoken to the officer who has said she "will definately take it to her boss as soon as she can" As you can imagine that is not good enough after we have had HER mistake hanging over us for so long! I have emailed back offering to take it to her boss for her.
