    HELP please

My understanding is that legally you have to work 6 hours before you are entitled to a half hour break - the head is talking rubbish. All schools have an sen budget if its not enough thats for the school to show the lea it isnt enough and negotiate with the lea for more funds. Refer them to rv oxfordshire county council ex parte 1996 elr
  3. Thats horrible. I would write to the school(was anyone taking minutes) if not and you took some write them up and ask all parties to sign them as a true account so you have a formal record of what they have all agreed to. If he is stressed( I would certainly put this in the letter) this will help your case later I would urge you to put the agreements in writing early - it will save a lot of probelms later if they try and go back on their words. ie you can show they acted illegaly. Dont get het up or too sympathetc with the issue of costs. Schools have an sen budget and this school has additional monies for the unit. If they arent using them correctly thats for them and the governors to discuss with the lea - its really not your probelm!
  4. <'> <'> They arent your friends Mel, they are paid to do a job (which they arent doing very well). I think they know theyve not handled this well. You could approach someone like Parent Partnership to mediate on your behalf. Something has to give Mel and this if is the best your area has to offer, well autism outreach or whatever it is in your area needs to have input, cos this unit is really struggling. I think you or your husband need to complain in writing, particularly with regard to the injury. Keep a diary and record what has been said - I think you will need it. I f I was a governor at this school I would be alarmed that was left in pain for so long and that school staff did not make any effort to seek medical help or contact the parents. I know the school is bullying you Mel but this is too important to just let it lie. <'>
  5. The school were negligent here, regardless of how the accident happened the staff allowed him to remain in school in pain without contacting you because they were trivialising his attempts to tell them what had happened and that he was in pain. I fully understand your reasons for wanting to keep him in this school, but for his own safety something needs to happen. He will never truelly be able to relax and feel successful in this school whilst they continue to treat him as a nuisance and someone whose voice should not be heard . What lessons is this treating him for life? I think you need to formally complain to the school, unit and governors, this is a case of clear negligence where the staff are completley out of touch with his needs to the point of it being downright dangerous <'>
  6. Great news but wasnt all this so unnecessary. If the school/unit had just done what it was supposed to do legally and morally all this upset and loss of schooling would have been avoided!
  7. Have you complained to the school? This is an offical complaint if ever there was one - I would not send my child back to this school!

    Help!!

I think you need to ask for an urgent review to reassess your sons needs, these have changed as cahms etc are saying he needs residental care this is from the ipsea website ---------------------------------- Ask your LEA to arrange an early review of your child?s Statement Back to top When can I ask for an early review? At anytime, as long as you have a good reason. The LEA must arrange a review of the Statement at least once every year. But if you believe that there is an urgent need for a change to your child?s Statement you should ask for a review to be arranged as soon as possible. What would be a good reason for asking for an early review? You should ask for an early review if you believe: that your child?s needs have changed and are no longer accurately described in Part 2 of the Statement; or that the provision in Part 3 of the Statement is no longer meeting your child?s needs. Should I speak to the school first? Yes, definitely. Speak to your child?s class teacher and the Headteacher about your worries as well as writing to the LEA. What if the school offers to write on my behalf? It is fine for the school to write as well as you if they believe that an early review is needed. But you should also write, as the parent. Who should I write to? Write to the top person at the LEA, usually called the Chief Education Officer or the Director of Education. You can find out what the top person is called in your LEA by asking at the school or the local library. Remember: keep a copy of any letter you send and ring IPSEA if you don?t get a reply after four weeks or if you want further advice. Model letter Dear Sir or Madam, (Child?s name) (date of birth) Request for an early review of a Statement I am writing as the parent of the above child, who has a Statement of Special Educational needs and attends .............. school. I would like the LEA to arrange an immediate review of the Statement. My reasons for making this request are: I look forward to an early reply. Yours sincerely,

  10. DO YOU HAVE ANYTHING IN WRITING FROM THE THE SCHOOL ABOUT WHAT THEY AGREED TO DO BEFORE THE HOLS? Even if you dont all is not lost, dig out the statement and see what it says I would follow ipseas advice(from the website) -------------------------------------------- Complain when your child is not getting the special educational provision on their statement How do I know what my child should be getting? This should be ?specified? in Part 3 of the Statement. Do the LEA have to ?arrange? this help? In law, the LEA must ?arrange the special educational provision? specified in a Statement. When should I complain ? If you discover that your child is not getting the special educational provision specified in Part 3 of the Statement or that the provision is being removed or reduced without the Statement being amended. Should I speak to the school about this? Yes, definitely. Speak to your child?s class teacher and the Headteacher about your worries as well as writing to complain to the LEA. What if the school offers to write on my behalf? It is OK for the school to write as well, but the most important thing is to write yourself. You, as a parent, are the only one who can take legal action in order to ensure that your child receives the provison specified in her Statement. The head can't do this, even if he or she wants to! Who should I write to? Write to the top person at the LEA, usually called the Chief Education Officer or the Director of Education. You can find out what the top person is called in your LEA by asking at the school or the local library. Remember: keep a copy of any letter you send and ring IPSEA if you don?t get a reply after two weeks or if you want further advice. Model letter Dear Sir or Madam, (Child?s name) (date of birth) Complaint that special education provision is not being made I am writing as the parent of the above child, who has a Statement of Special Educational needs and attends .................. school. Under Part 3, the Statement specifies the special educational provision my child should receive and I understand that you have a legal duty to ?arrange? this provision. I am sorry to have to inform you that you are in breach of this duty, on the grounds that the following provision is currently not being made: Please reply to this letter as soon as possible, but in any event within 5 working days of receiving it, confirming the steps that you will take to ensure that the special educational provision specified in my child?s Statement will, in fact. be made. I look forward to an early reply and trust that it will not be necessary to take this matter further. Yours sincerely, You can download this advice and the model letter as a Word document: Support Sheet 7: Complaint over failure to provide provision specified in the Statement
  11. I think you are making a massive mistake dropping the tribunal do you have anything in writing from them to say they will let him go to the school you want as long as you drop the case? If not ask for it asap. I think you are letting the fact you want this over to cloud your judgement. They are conning you and you need advice from ipsea and confirmation from the lea ASAP t gtonr
  12. I presonally would have a look at www.benefitsandworks.co.uk You pay 16.50 for the year but for the knowledgeand quality of advice I feel it was money well spent!
  13. I think they would have difficulty arguing this rule as to me it really would be a breach of the disability discrimination act! Personally I dont think they would win!
  14. Have you had any indication from the school that the normal sibling rules will not apply? I just think its too early to worry about this if you havent had any indication this will be their stanse. I would be interested saying that to hear what ipsea has to say about it?
  15. The words illegal and disability discrimination act spring to mind. Does the sen governor have any idea about any of this because ofsted would have a field day with these breaches of the code of practice! http://www.ipsea.org.uk/dda-swimming-case.htm

  17. Brilliant. I recognised a lot of myself in the parents and the kind of things I say to my oldest child. If only school, social services, even family would see that there is so much pressure on our families and how little things could really help ie respite, offering to take them out, etc. It makes such a difference. In our area they sent out a leaflet to my oldest about a sibling group but really it was years too late(aimed at a younger age group ) and to be honest was a bit patronising. Its hard enough being a teenager but our kids have so much more responsibility placed on them - iI KNOW i do as she often can handle little p much better than her teachers, other family memebers etc
  18. Model letter Dear Sir or Madam, (child?s name) (date of birth) Request for formal assessment I am writing as the parent of the above child to request an assessment of his special educational needs under the 1996 Education Act. (child?s name) attends ..................... school. I believe that (child?s name)'s special educational needs are as follows: My reasons for believing that the school cannot on their own make the provision required to meet my child?s needs are: I understand that you are required by law to reply to this request within six weeks and that if you refuse I will be able to appeal to the Special Educational Needs Tribunal. Yours sincerely,
  19. No unless its been agreed to. Have a look at the ipsea website as i seem to think they have a good proforma letter to use regarding this - it could be they are hoing you wont noticce!
